We hold this property for the future use of University High School. We support the proposed West 116th Street Overlay Zone, however request that approximately one-third of our most southern property and the 5.5 acre lot fronting Towne Road (a total of approximately 35 acres) be exempted from this Overlay Zone. Overall, the school either owns, or has access through this LLC, to 115 acres. Based on our current preliminary Master Plan (attached), we may be able to sell portions of our most southern property for residential development. Given the potential economic value to the school, we must consider this possibility. With the school use of the majority of this site we believe exempting this land would still be consistent with the intent of the Overlay Zone. We appreciate your consideration of this request. Mr. Jim Sourwine has reviewed and discussed with us the above referenced proposed West 116th Street Overlay Zone. Mr. Sourwine is concerned that the proposed overlay zone is not consistent with the comprehensive plan and believes that the same is inconsistent with the current character of West 116th Street between Spring Mill Road and the Boone County line. While there are some single family estate type properties equal to or in excess of three acres each in this corridor, the majority of the properties have not developed that way and to impose the same would deprive many owners, including the Sourwine family, of the reasonable expectancy they have in their investments in their properties in this corridor. A limitation of one acre per home is much more reasonable and consistent with the area and is more consistent with the existing S-1 residential zoning which is standard that preceded the existing developments. In addition, the Sourwines believe this proposed overlay zone is not in keeping with the supply and demand for lots and luxury homes in West Clay. Further, several of the most upscale neighborhoods in West Clay Township would not meet such proposed criteria. For example, none of Winterwood, Laurelwood, Claybridge, Estates of West Clay and Coppergate, which are all viewed as premier neighborhoods, would meet the proposed criteria. These neighborhoods contribute to the highest home per lot investment and assessed value in West Clay. Under the proposed overlay zone, neighborhoods of this type, which would protect the character of existing estate development in this corridor, would be precluded.
