EXPLANATION
The Applicant, Pulte Homes of Indiana, LLC ("Pulte"), is requesting a
Subdivision Regulation Waiver ("Waiver") for three (3) lots in the Cherry Creek Estates
subdivision from Section 7.00.01 of the Carmel Subdivision Control Ordinance
("ROSO"), which requires that dwellings be separated a minimum of six (6) feet. Cherry
Creek Estates consists of approximately three hundred forty-nine (349) home sites. For
approximately one-hundred forty-four (144) of the home sites, Pulte proposes to build its
"empty-nester" home product offerings. Lots 131, !32 and 133 are the lots which are the
subject of this request, and are located in the "empty-nester" section of Cherry Creek
Estates. Due to a mistake, construction of homes on each lot has commenced, and the
homes do not comply with the minimum dwelling separation requirement under ROSO.
The requested Waiver will not be detrimental to public health, safety and welfare and,
absent the Waiver, construction of each home on the three lots cannot be completed.
The following exhibits describe Pulte's request:
Exhibit 2 - This is an aerial photograph of the real estate. Cherry Creek Estates
consists of approximately 149'.538 acres and is located east of and adjacent to
Hazel Dell Parkway and south of 146th Street. The lots which are the subject of
the request are outlined in yellow.
Exhibit 3 - This is a rendering of Lots 131,132 and 133 in Cherry Creek Estates
plat. The dwelling separation for each lot is indicated on the rendering.
Exhibit 4- These are photographs of the dwellings located on Lots 131,132 and
133.
Exhibit 5 - These are photographs of other homes in Cherry Creek Estates which
demonstrate dwelling separation of homes near the homes which are the subject
of the request.
Pulte looks forward to presenting this matter to the Carmel Plan Commission at
its July 5, 2005 meeting.
