DEPARTMENT REPORT
OCTOBER 29, 2013
1. (V) Eden Estates, Sec 3, Lot 92, Lot Coverage.
The applicant seeks the following development standards variance approval for a pool and garage:
Docket No. 13090008 V ZO CH: 7.04.F Max lot coverage 35 %, 46.5% requested.
The site is located at 3666 Walden Place. The site is zoned R -1 /Residence. Filed by William Tabberson of
Tabberson Architects, on behalf of the owners.
General Info:
The Petitioner requests variance approval
to add a garage /pool house and patio
space, which will increase their lot
coverage. The site is a little over a half an
acre and is surrounded by other single
family homes. Please refer to the
petitioner's information packet for
more details.
Analysis:
The petitioner has recently added a pool
and spa and would like to add a one car
garage which would also function as a
pool house. This will put them over the
allowed lot coverage by about 11%.
Lot coverage is calculated by calculating
the area of all impervious surfaces on a
lot, including such things as driveways
and sidewalks. This site has a very long driveway because the garage is rear loaded. The rear loaded garage is
aesthetically pleasing for the neighborhood, but it does put some hardship on the owners for improving their lot.
The new garage meets the minimum setbacks for the district, and the petitioner plans to install pervious pavement in the
driveway. The pervious pavement will help offset some of the impervious surface on the lot.
The approval of these variances should not have a negative effect on surrounding properties as it will increase the property
value and is only exceeding the lot coverage by 11 %. The Department is in support of this variance request.
Petitioner's Findings of Fact:
1. The approval of these variances will not be injurious to the public health, safety, morals, and general
welfare of the community because: it is a property upgrade to a single family residence that improves the
property usage and safety.
2. The use and value of the area adjacent to the property included in the variances will not be affected in a
substantially adverse manner because: this improvement enhances the usage and safety around this
property.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: the driveway length would limit the hardscape.
Recommendation: The Dept. of Community Services recommends approval of Docket No. 13090008 V.
