2. (V) 3822 W 141' Street.
The applicant seeks the following development standards variance approval for 2 homes on 1 lot during
construction:
Docket No. 13100002 V ZO CH: 2.04 No more than 1 principal building per lot.
The site consists of 5 acres and is located at 3822 W 14151 Street. The site is zoned S- 1/Residence. Filed by Stacy
Walton of Cross County Consulting, on behalf of the owners.
General Info:
The Petitioner requests Variance approval, to allow
an existing home to remain on the lot until the new
home is constructed. The site is located along 14151
Street, west of Shelborne Road and is surrounded by
residential properties. Please refer to the
petitioner's information packet for more details.
Analysis:
The Zoning Ordinance only permits 1 home per lot.
The petitioner would like to be able to remain living
in the existing home on the site while a new home is
being built. The site is 5 acres and both homes meet
the setback requirements; with the new home being
setback over 300 feet from the street. This variance
should not have a negative effect on surrounding
properties as the parcel is very large and the old home
will be demolished after the new one is constructed.
The Department is in support of this variance; however we would ask that the petitioner commit to demolishing the
existing home within 30 days of completion of the new home.
Petitioner's Findings of Fact:
1. The approval of this variance will not be injurious to the public health, safety, morals, and general
welfare of the community because: variance approval will allow construction of a residential dwelling.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the proposed dwelling has a substantial value vs. the existing
dwelling.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property because: variance allows temporary existence of existing dwelling
while construction of the proposed dwelling.
Recommendation: The Dept. of Community Services recommends approval of Docket No. 13100002 V with the
commitment that the existing home will be demolished within 30 days of completion of the new home.
