The minutes of the June 24, 2013 meeting were approved. Department Report Alexia Donahue—Wold: • Items 1-2,Docket Nos. 13020024-25 V Holiday Inn—Signage have been table to August 26, 2013. Legal Report John Molitor: • Ephraim Wilfong has resigned. Vacancy needs to be filled as soon as possible. James Hawkins nominated Leo Dierckman,Brad Grabow seconded. Leo Dierckman was named Vice President of the Board of Zoning Appeals. 1-2. WWW.CARMEL.IN.GOV Page 1 of 3 (317) 571-2417 Carmel Board of Zoning Appeals July 22,2013 Petitioner Dave Coots: O Building was built in 1981,due to growth of firm, expansion of building is needed o Propose 44 ft ROW in lieu of 50 ft half ROW requirement per Carmel Transportation Plan o Back in the 60's the ROW was 40 ft o Drainage from roof of Racquet Club has been an issue in the past o Dept has requested dedication of 10 ft off of Carmel Drive which will encroach upon 12 parking spaces o Due to thoroughfare plan of Carmel Drive this is impacting their parcel o Lenders are a little nervous about portion of collateral being consumed by Carmel Drive o Comprehensive plan was amended in 2010 to 50 ft o Asking that ROW be reduced from 50 ft to 44 ft Staff Comments Alexia Donahue-Wold: o Dept does not find it a problem dedicating 10 feet to the City and complying with the Zoning Ordinance O We would be willing to grant a consent to encroach o We are not in support of this variance Discussion with Dave Coots: Leo Dierckman o Do you still use main entrance? Yes O Would city have to pay you for parking spaces if Cannel expanded Cannel Dr? Yes o How many years have you been there? Since 1981 o Is anything going on in the front of the building as far as a redesign? No o How big is your existing building? 10,000 sf What is footprint of building? Adding in 2200 sf in footprint James Hawkins o How big is the addition? 5800 sf including basement for storage O Where are handicap spots located? At front of building by door. In 1985 we were asked to dedicate additional space for sidewalk and curbs O Is your parcel only that building or does it extend back into complex? New addition extends across old property line that we acquired from Cannel Racquet Club O Are there any cross easements for parking with Racquet Club? Yes Brad Grabow o Are you in compliance with Carmel as far as parking spaces go? Yes. Will you be if the 12 spaces are removed? No. How short will you be? About 8. We can enlarge the landscape island to make up about 2-3. O What does the extra footage made up of? Alexia—Sidewalks,maintenance etc o What type of needs will there be for future? Alexia—talked with Engineering Dept about the possible need for turn lane in future o How many other locations along Cannel Drive do we have this same 50 ft ROW problem with? Alexia— Bank, McDonalds Alexia Donahue-Wold o You still having parking in front besides the 12 spaces correct? Yes Alexia-we are only asking for ROW and not 10 ft path that is normally required Leo it ierckman O I understand the Dept wanting to do the best for Cannel but I also understand the parking situation James Hawkins O Is there any extra space between parking rows to condense and make more spaces? I went to pick up donation funds for a charity that we were both involved in. Brad Grabow • If we approve this variance, we limit the city's ability to widen Carmel Drive in the near future. What are you looking for out of tonight? Dave -The building department will not issue a permit to do the addition until this is cleared up. Leo Dierckman • It comes down to what's fair to the property owner and what's a reasonable request. Leo motioned to approve this docket,Brad seconded.
