Docket No. 05020038 Z and 05020039 DP/ADLS: Jackson Square Planned Unit Development The applicant seeks to rezone 7.3 acres from B6/Business to PUD!Planned Unit Development for the purpose of creating a two story commercial building and 38 townhomes. The site is located at SE comer of 136th Street and Pro Med Lane. Filed by Paul Reis for Justus Home Builders. The public hearing for this item was held at the April 19th Plan Commission meeting. There were several members of the public that voiced concerns. The Subdivision Committee met on May 3rd. After discussion that included public input they forwarded a favorable recommendation by a 4-1 vote subject to the condition noted below for the DPI ADLS. The Department recommends that the Plan Commission forward Docket No. 05020038 Z to the City Council with a favorable recommendation. The Department recommends that the Plan Commission approve Docket No. 05020039 DP/ADLS subject to approval of the PUD ordinance by the City Council and the developer installing one-half of the guest parking at this time rather than land-banking, (the entry area will be left intact for now and land-banked for future parking.) Background: The applicant is requesting approval of a Planned Unit Development to allow the construction of an office building and 38 townhomes. Included with the PUD Ordinance are the ADLS and Development Plan for the site. This site falls within the 600' US 31 boundary overlay. This is the case with several of the lots within the adjacent Kensington Place addition. Likewise the sites across US 31 contains both single-family residential, attached residential (townhomes), retail and office uses. The Commission may recall the discussion of the Hunters Creek PUD where the Lockerbie Townhomes now sit. That was a request where office was proposed on a site within the overlay and denied by the City Council after an 11-2 unfavorable recommendation from the plan Commission. Later a proposal consisting oftownhomes was approved by the City Council with a favorable recommendation from the Commission. That proposal was seen as a reasonable transition between the uses along the corridor and the primarily single family uses further to the west. The existing site permits office development throughout and the applicant desires to construct office adjacent to Srnokey Row Road with a townhome component adjacent to existing townhomes to the east. A 45' buffer is proposed between the existing and proposed townhomes where if developed as office a 50' buffer was required as part of the original zoning for Pro Med Park. While it is typically unnecessary to buffer compatible uses the applicant maintained 45' of the 50' previously committed to tree preservation area as many adjacent neighbors in Kensington Place had the understanding that the area was to remain in a natural state between their homes and future three to four story office development.
