ADJOURNMENT 3 COMMON COUNCIL MEETING MINUTES MONDAY, NOVEMBER 18, 2013 - 6:00 P.M. COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEMBERS PRESENT: Mayor James Brainard, Council President Richard L. Sharp, Council Members Carol Schleif, W. Eric Seidensticker, Sue Finkam, Luci Snyder, Ronald E. Carter, Kevin D. Rider, Clerk-Treasurer Diana L. Cordray and Deputy Clerk Lois Craig. Council President Sharp called the meeting to order at 6:02 p.m. Pastor Graham Richards, Central Christian Church, pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Seidensticker made a motion to approve minutes from the November 4, 2013 Regular Meeting. Councilor Schleif seconded. There was no Council discussion. Council President Sharp called for the vote. Minutes were approved 7-0. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL: Jim Reilly, Executive Director, Actors Theatre of Indiana, presented an update of the Theatre's past, current and future plans to the Council. COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: Councilor Snyder addressed the Council regarding the Hamilton County Humane Society. Councilors Carter and Snyder addressed Mr. Reilly. Councilor Finkam addressed the Council regarding the Carmel PorchFest that will be held on Sunday, September 14, 2014 in the Arts and Design District. ACTION ON MAYORAL VETOES: There were none. 1 CLAIMS: Councilor Seidensticker made a motion to approve claims in the amount of$2,121,746.83. Councilor Schleif seconded. There was no Council discussion. Council President Sharp called for the vote. Claims were approved 7-0. Wire Transfers - Month of October 2013: Councilor Seidensticker made a motion to acknowledge wire transfers in the amount of$1,382,022.03. Councilor Schleif seconded. There was no Council discussion. Council President Sharp called for the vote. Wire Transfers were acknowledged 7-0. COMMITTEE REPORTS: Councilor Snyder reported that the Finance, Administration and Rules Committee had met and discussed Ordinance D-2156-13 and Ordinance D-2160-13. The committee report will be given when the items appear on the agenda. The next meeting will be held on Thursday, November 21, 2013 at 5:30 p.m. Councilor Seidensticker reported that the Land Use, Annexation and Economic Development Committee had not met. The next meeting will be held on Tuesday, November 26, 2013 at 5:30 p.m. Councilor Carter reported that the Parks, Recreation and Arts Committee had not met. Councilor Finkam reported that the Utilities, Transportation and Public Safety Committee had not met. This item was amended in the Finance Committee to strike the $50,000 for the Mayor's Office, Other Accounting Fees. Councilor Seidensticker clarified that lines 37-41 were to be stricken from the ordinance. Councilor Seidensticker made a motion to approve Ordinance D-2160-13 As Amended. Councilor Snyder seconded. Mayor Brainard addressed the Council. Councilor Snyder made a motion to amend Ordinance D-2160-13. Councilor Seidensticker seconded. There was brief Council discussion. Council President Sharp called for the vote. The motion to amend Ordinance D-2160-13 was approved 7-0. Councilor Seidensticker also clarified that lines 17-18 and lines 22 (starting after services) thru the end of line 22, all of line 23 and all of line 24 would also be stricken from the ordinance. Councilor Seidensticker made a motion to approve Ordinance D-2160-13 As Amended. Councilor Snyder seconded. There was no Council discussion. Council President Sharp called for the vote. Ordinance D-2160-13 was adopted 7-0. Councilor Seidensticker made a motion to suspend the rules and not send this item to committee and vote this evening. Councilor Schleif seconded. There was no Council discussion. Council President Sharp called for the vote. The motion was approved 7-0. There was brief Council discussion. Councilor Seidensticker made a motion to approve Ordinance Z-582-13. Councilor Carter seconded. There was no Council discussion. Council President Sharp called for the vote. Ordinance Z-582-13 FAILED 0-7. NEW BUSINESS Council President Sharp announced the First Reading of Ordinance D-2161-13; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Carmel City Code Chapter 6, Article 4, Section 6-65 (Use of Weapons Prohibited). Councilor Seidensticker made a motion to move this item into business. Councilor Schleif seconded. Councilor Seidensticker presented this item to the Council. There was no Council discussion. Council President Sharp referred Ordinance D-2161-13 to the Utilities, Transportation and Public Safety Committee for further review and consideration. Council President Sharp announced the First Reading of Ordinance D-2162-13; An Ordinance of the Common Council of the City of Carmel, Indiana, Amending Chapter 6, Article 5, Division VII, Section 6-158 (Noise Regulations). Councilor Sharp nominated John Clair. Councilor Seidensticker seconded and made a motion to close the nominations. Councilor Sharp seconded. There was no Council discussion. Councilor Finkam called for the vote. John Clair was appointed 7-0. Council President Sharp reclaimed the gavel from Councilor Finkam.
