However, the existing large setback of over 300 feet for this `;i. -, ` 1 home and the desire to preserve existing trees, make it difficult to Y ,,; f„ meet the requirements of the Ordinance. 300 feet is a significant setback and much more than the required front yard setback for a ' - t" -1 `Y home. This distance will help buffer the view of the garage from the.". . 41 • " t,r ' ' *" street. Also, the architecture of the garage will coordinate with the t ,, , 1' . The Department is in support of this variance. Petitioner's Findings of Fact: 1. The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: it will tie in beautifully with architecture to the existing home, increasing property value and meeting owner's needs. The work will not disturb adjacent properties in any manner. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: we are keeping a 20 foot distance to the adjacent property line, which is more than the required distance of 5 feet. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: it will destroy beautiful mature trees and eliminate that natural privacy and beauty. Recommendation- The Dept. of Community Services recommends approval of Docket No. 13100028 V. 5
