Dear Mr. Ochs:
This lette~ is to explain the Occupancy Group status of the Old Town Shops project and to provide
clarification to the Building Dep~ent so permits can be issued accordir~gl~.
The project was designed and filed with the State Building Commission as a "Shell designed to meet
multiple Occupancy Group classifications Its size, stairway configuration, construction type, and demising
wall design, all perlnit a r~ixed use occupancy and combinations df the following three separate Occupancy
Groups:
Occupancy Group B Business
Occupancy Group M Mercantile
Occupancy Group R3 Residential - Apartmen~
I have attached a copy of our code consultant's research report identifying these Occupancy Groups and
their basis for compliance. Our consultant investigated Occupancy Group A3 Assembly, however we have
determined that there is no potential A3 Assembly occupancy in this project. Only the three Occupancy
Groups noted above are viable uses.
AS our consultant's report states, and as Ishave verified by independent code research the Old Town Shops
construction type, stories, and square footage configuration support any combination of Business
Mercantile and Residential occupancy. Tenants will be responsible for filing apprOPriate documents under
the State Release for Shell Construction, along with local requirements.
