b. Fifth Reading of Ordinance D-2154-13; An Ordinance of the Common Council of the
City of Carmel, Indiana, Establishing a Department of Storm Water Management and a
Storm Water District, and Adopting and Approving Storm Water User Fees; Sponsor(s):

c. Third Reading of Ordinance D-2158-13; An Ordinance of the Common Council of the

City of Carmel, Indiana, Amending Ordinance Z-576-13 (ADOPTED by Council 9/16/13)
Regarding the Development Requirements of the Cannel Drive—Range Line Road
Overlay Zone in the Carmel Zoning Ordinance. This item is being returned to the Council
from the Plan Commission with a DISAPPROVAL of the Council's Amendments to
Ordinance Z-576-13; Sponsor: Councilor Rider. Sent to the Land Use, Annexation and
Economic Development Committee (11/26/13).
g. Resolution CC-09-17-12-01; A Resolution of the Common Council of the City of
Cannel, Indiana, Amending the Cannel Clay Comprehensive Plan"C3 Plan 2009"
Regarding the Transportation Plan; Sponsor: Councilor Rider. Remains in the Land Use,

COMMON COUNCIL
MEETING MINUTES
MONDAY, DECEMBER 2, 2013 - 6:00 P.M.
COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE
MEMBERS PRESENT:
Mayor James Brainard, Council President Richard L. Sharp, Council Members Carol Schleif, W. Eric
Seidensticker, Sue Finkam, Luci Snyder, Ronald E. Carter, Kevin D. Rider and Deputy Clerk Treasurer
Lois Craig.
Clerk-Treasurer Diana L. Cordray was not in attendance.
Mayor Brainard called the meeting to order at 6:02 p.m.
Pastor Mark Wright, Hazel Dell Christian Church, pronounced the Invocation.
Mayor Brainard led the Pledge of Allegiance.
RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS:
There were none.
APPROVAL OF MINUTES:
Councilor Seidensticker made a motion to approve minutes from the November 18, 2013 Regular
Meeting. Councilor Schleif seconded. There was no Council discussion. Council President Sharp
called for the vote. Minutes were approved 7-0.
RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL:
There were none.
COUNCIL, MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS:
Councilor Snyder addressed the Council regarding the Hamilton County Humane Society.
ACTION ON MAYORAL VETOES:
There were none.
CLAIMS:
Councilor Seidensticker made a motion to approve claims in the amount of$3,338,381.91. Councilor
Schleif seconded. There was no Council discussion. Council President Sharp called for the vote.
Claims were approved 7-0.

COMMITTEE REPORTS
Councilor Snyder reported that the Finance, Administration and Rules Committee had met and discussed
Ordinance D-2154-13 which was referred back to the Council with a favorable recommendation.
Councilor Seidensticker reported that the Land Use, Annexation and Economic Development
Committee had met and discussed Ordinance Z-583-13 which was referred back to the Council with a
favorable recommendation.
Councilor Carter reported that the Parks, Recreation and Arts Committee had not met.
Councilor Finkam reported that the Utilities, Transportation and Public Safety Committee had not met.
Report from the Council Appointee to the Redevelopment Commission. No one was available to give a
report.

Council President Sharp announced the Fifth Reading of Ordinance D-2154-13; An Ordinance of the

Transportation and Public Safety Committee for further review and consideration. Mayor Brainard
addressed the Council.

Council President Sharp announced Resolution CC-09-17-12-01; A Resolution of the Common Council
of the City of Carmel, Indiana, Amending the Carmel Clay Comprehensive Plan "C3 Plan 2009"
Regarding the Transportation Plan; Sponsor: Councilor Rider. Remains in the Land Use, Annexation
and Economic Development Committee. Councilor Rider referred to Adrienne Keeling, Department of
Community Services, to address the Council. Mayor Brainard addressed the Council.
Ordinance Z-583-13 (continued): Council President Sharp referred to Assistant City Attorney,
Ashley Ulbricht, to address the Council. Councilor Seidensticker made a motion to sustain the vote and
approval of Ordinance Z-576-13 previously adopted by the Council on 9/16/13. Councilor Schleif
seconded. There was brief Council discussion. Council President Sharp called for the vote to sustain
the vote and approval of Ordinance Z-576-13 previously adopted by the Council on 9/16/13. The vote
was sustained 5-2 (Councilors Carter and Rider opposed).

ANNOUNCEMENTS
Councilor Snyder addressed the Council regarding the Actors Theatre of Indiana production of"Frog
and Toad" December 13th thru December 22 11d.
Council President Sharp informed the Council that the election of the 2014 Council President would be
placed on the December 16, 2013 agenda.
