Z-478-05 4 AN ORDINANCE OF THE COMMON COUNCIL OF THE 5 CITY OF CARMEL, INDIANA 6 7 An Ordinance amending vehicle sign regulations of and making a variety of corrections to the 8 Carmel Zoning Ordinance 9 10 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in 11 IC 36-7-4), each unit of local government that wishes to adopt land use and zoning ordinances 12 must first approve by resolution a comprehensive plan for the geographic area over which it has 13 jurisdiction; and 14 WHEREAS, the 2020 Vision Comprehensive Plan (the "Comprehensive Plan") Docket 15 No. 16-96 CP was given a favorable recommendation by the Carmel/Clay Advisory Plan 16 Commission on August 20, 1996, and duly approved by Resolution No. CC-09-03-96-03 of the 17 Common Council on September 24, 1996, and is therefore the official Comprehensive Plan of 18 the City of Carmel and Clay Township; and 19 WHEREAS, the City wishes to amend development standards in the Zoning Ordinance 20 to regulate vehicles functioning as signs; and 21 WHEREAS, the City wishes to maintain an orderly, consistent and streamlined Zoning 22 Ordinance; and 23 WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authorized to 24 amend the text of the zoning ordinance; and 25 WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. D- 26 1600-02, the Carmel Zoning Ordinance is incorporated by reference into the Carmel City Code; 27 NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of 28 Carmel, Indiana, that, pursuant to IC 36-7-4-600 et seq. and after Docket No. 05050010 OA 29 having received a favorable recommendation from the Carmel Advisory Plan Commission on 30 Tuesday, May 17, 2005, it hereby adopts this Ordinance to amend the Carmel Zoning Ordinance 31 (Ordinance No. Z-289, as amended), to read as follows: 32 Section I: 33 CHAPTER 4: DISTRICTS & BOUNDARIES 34 a. Amend Section 4.01: Zoning Districts Established to read: 35 4.01 Zonin!! Amend Section 25.07.01-04: Prohibited Signs; **q to read: 25.07.01-04 Prohibited Si2l1s. The following types of signs are prohibited: q) It shall be prohibited to park or use a vehicle in such a way as to function as a sign, defined to include the parking of any vehicle, trailer or similar movable structure containing or supporting any signage between the right-of-way line and any public street and !he !!feater of two distances: forward of the Front Line of Building of the Principal Building or one. hundred-fiftv (50) feet from the Dublic right~, with the exception of: (i) Vehicles actively involved in construction on or serving of the site; (ii) Vehicles delivering products to the site in designated loading areas; (Hi) Vehicles parked in designated truck parking areas of a development that have been screened from or are not generally visible from the public right- of-way; (w~) Passenger vehicles, pick-up trucks, and vans of a size that can fully fit within a standard parking space, containing signs painted on or Ordinance No. Z-478-05 2 OS/27/2005 1 2 permanently affixed on the doors or integral body panels that do not exceed sixteen (16) square feet in area.
