WHEREAS, Phillips' portion of the improvement includes installing a fence over a
portion of the boundary line;
WHEREAS, Robinson's portion of the improvements includes the relocation ofa
sidewalk curb; ,~
WHEREAS, the parties wish to memorialize, in a recordable format, certain agreements
concerning such improvements.
NOW, THEREFORE, in connection of the respective improvements made by each party,
they agree as follows:
1) Installation ofFence. Phillips, at his expense, agrees to install a privacy fence
from his 'Nest boundary line to the front edge of his residence. In order to accommodate
Robinson '.s need for passage of automobiles, Phillips will locate such fence one (1) foot south of
the boundary line. Robinson agrees to instruct his occupants to avoid such fence when driving
. onto his parking area. Robinson acknowledges that:
a) Phillips may, at his expense, install a 2 x 6 inch plank with reflectors on
the fence in order to protect the fence and warn Robinson's tenants of the location of the fence;
b) he will be responsible for any damage to the fence and/or barrier caused
by passage along the fence by the occupants;
2) Relocation of Driveway and Installation of New Curb. Robinson, at his expense,
will relocate his driveway entrance 4 feet north of its current location. In addition, Robinson, at
his expense, agrees to build a new curb for access to his driveway. Such curb will not be located
on any part of Phillips' Property. Such curb will be completed in a reasonable amount of time;
3) Acknowledgement of Respective Property Lines. Each party acknowledges that
neither has any claim, or any implied or express easement or other oral or written agreement
concerning the right to have vehicles and/or persons use the Phillips' north boundary line as part
of a driveway or other walkway or passage way/access to the Robinson Property. Further, each
party aclmowledges that either party may record this instrument in the event any question or
concern arises over the north location boundary line between the properties or the use of such
property for ingress/egress purposes;
4) Advise City. Phillips will notify the. City of Carmel that he has amicably resolved
all disputes with Robinson and that he has no objection to Robinson's resolution of his current
litigation with the City and that Robinson's use of his rental property in its current condition and
acceptable to him.
IN WITNESS WHEREOF, the parties hereto have caused these presents to be executed
the day and year first above written.
