Commitments Attendant to
Primary Plat Amendment and Secondary Nat Approval of
Docket Nos. 54-02 PP Amend & 55-02 SP
(Little Farms Addition, Lots 46a and 46b)
Timothy M. &Melanie Brower(hereafter, "Applicant") makes the following Commitments to the
City of Carmel & Clay Township Plan Commission:
Description of Real Estate:
Lot Number 46 in the Little Farms Addition, an addition in Hamilton County,
Indiana, as per plat thereof, recorded in Deed Record 109, page 50, in the Office of
the Recorder of Hamilton County, Indiana.
Statement of Commitments:
1. At the time sidewalks and/or curbs&gutters are installed adjoining this property by other
parties, the Applicant will install a sidewalk system and/or curbs & gutters the full
width of the property.
2. At such time as plans are adopted by the City of Carmel or Hamilton County that call for
the installation of sidewalks and/or curbs & gutters adjoining this property, the
Applicant will install a sidewalk system and/or curbs &gutters the full width of the
property.

3. At such time as either the City of Carmel/Clay Township Plan Commission or the
Director of the City of Carmel Department of Community Services requires a
sidewalk system and/or curbs&gutters to be installed on this property,the Applicant
will install a sidewalk system and/or curbs & gutters the full width of the property.
4. Said sidewalk system and/or curbs &gutters shall be designed to meet the requirements
of the Carmel/Clay Subdivision Control Ordinance and the Carmel/Clay
Thoroughfare Plan. Said sidewalk system and/or curbs&gutters shall be constructed
to the standards of the City of Carmel.
5. The Applicant understands that the representations made above will survive the
ownership of the property. The Applicant will make the requirements above an
integral part of any agreement to sell the property.
Binding on Heirs,Successors and Assigns. These commitments are binding on the owner of the
Real Estate,each subsequent owner of the real estate, and each person acquiring interest in the real
estate, unless modified or terminated by the governmental authority authorized to modify.
Recording. The undersigned agrees to record these commitments in the Office of the Recorder of
Hamilton County, Indiana, upon granting of the approval of the project.
Enforcement. These commitments may be enforced by the Carmel/Clay Plan Commission and/or
the City of Carmel, Indiana.
