Furthermore, the terms of the Agreement shall be amended to include the E-verify requirement as stated in Indiana Code § 22-5-1.7 et seq., which is attached hereto and incorporated herein as Exhibit "B", as well as the required E-verify Affidavit, attached hereto and incorporated herein as Exhibit "C". Also, pursuant to I.C. § 5-22-16.5, Vendor shall certify that in signing this document, it does not engage in investment activities within the Country of Iran. The terms and conditions of the Agreement shall not otherwise be affected by this Additional Services Amendment and shall remain in full force and effect. PE Carmel City Engineer One Civic Square Cannel, Indiana 46032 Re: Annual Monitoring and Reporting Bray Homestead, Carmel, Hamilton County, Indiana Supplemental Agreement to Contract 0602.10.04 Dear Mr. McBride: On behalf of American Structurepoint, I am pleased to submit this proposal for the annual monitoring and reporting in accordance with the Section 401 Water Quality Certification Modification conditions for the wetland mitigation constructed at the Bray Homestead site for the Illinois Street Extension project. The professional services will include monitoring and reporting described in Exhibit A attached. Upon receiving notice to proceed from the City of Carmel, American Structurepoint will begin performing services for the not-to-exceed fee of$19,100. Invoices will be forwarded to the City of Carmel on a monthly basis in accordance with our original contract. We look forward to working with the City of Carmel on this project. Exhibit A SCOPE OF SERVICES Annual Monitoring and Reporting Bray Homestead Carmel, Hamilton County, Indiana BASIC SERVICES The proposed project includes completing three to five years of annual monitoring and reporting in accordance with the wetland mitigation checklist prepared for the proposed wetland mitigation site for the Bray Homestead. The proposed scope of services for the wetland delineation report includes the following. 1. Annual Monitoring a. Prepare As-Built Documentation i. Assemble as-built documentation, including any as-built plans. plant quantities and species, and construction documentation ii. Prepare letter to regulatory agencies documenting the site has been constructed iii. As instructed by the Client, we will submit the as-built letter and supporting documentation to regulatory agencies indicating that the first year of monitoring will occur in 2013. b. Conduct Annual Site Investigation (years 2013-2017) i. It is anticipated that two site visits will be conducted each year to assess the success of the site and establishment of planted species. One site visit will be conducted in late spring: the second will be conducted in late summer or early fall. ii. Assessment and documentation of dominant plant species and success of planted species and documentation of invasive species in accordance with the permits and Mitigation and Monitoring Plan iii. Photography of the site with a 360-degree panorama taken from a fixed point in the mitigation area iv. Assessment of water levels within the mitigation area v. Observations of soil conditions i- .r— vi. Completion of Routine Wetland Delineation Data Sheets for sample points vii. Scale drawings of the mitigation site viii.Monitoring must be completed for a minimum of three years or until the site has met the success criteria for two consecutive years. Recommendations for remedial action will be included with each annual monitoring report. c. Preparation of Annual Monitoring Reports (years 2013-2017) i. Annual monitoring reports will be prepared and submitted to the resource agencies on or before December 31s' of each monitoring year. d. Wetland Delineation of the mitigation site documenting the amount of wetland that has been created (year 2017 only) i. During the final year of monitoring, a Wetland Delineation will be completed on the mitigation site to document the total amount of wetland created within the wetland mitigation site. The Wetland Delineation will be included in the final year monitoring report with the request for release from additional monitoring. II. ADDITIONAL SERVICES Fees for the following professional services are not included in the fee for Basic Services. These services shall be provided only if authorized in writing in advance. • Construction staking, descriptions/exhibits for right-of-way or easements, or topographic survey • Services resulting from changes of scope or magnitude of the project, as described above • Maintenance activities or remedial actions such as invasive species treatment, hydrology alteration, or grading III. FEE SCHEDULE BASIC SERVICES Compensation for the professional services described as part of Basic Services will be as outlined below. The fees shown arc lump sum and will be invoiced monthly on the basis of the approximate percentage of the services completed. If the assumptions made in the scope of services relative to extent of work are found to change, you will be notified in writing and a new (extra or reduced) fee will be presented.
