That by said orders the Court also appointedthree disinterested freeholders of Hamilton County to assess the'.damages and benefits to the defendants caused by the appropriations. 4. .That on September 30, 1980 said court-appointed appraisers returned their report to the Court showing total damages in the sum of Sixty -Six Thousand Two Hundred Sixty -Four Dollars. and Twelve Cents.($66,264.12). 5. That the plaintiff, City of Carmel, paid the award of the appraisers together with the fees for the services of said appraisers to the Clerk of the Court on September 30, 1980 and said amount was subsequently withdrawn by defendants, Estridge Properties, an Indiana General Partnership, Donald Estridge, and Hannah Estridge. 6. That the defendants, Estridge Properties, an Indiana General Partnership, Donald Estridge, and Hannah Estridge, filed exceptions to the court-appointed appraisers' within the period provided therefor by statute. 7. That the total value of the fee simple title of defendants' real estate and temporary easement for highway; right-of-way taken and the damages to the remainingland of the defendant is Seventy -Three Thousand Dollars ($73,000.,00),H;which sum includes any interest to which the defendants maybe entitled, and that the defendants, Estridge Properties, an Indiana'General Partnership, Donald Estridge, and Hannah Estridge, should recover ;. from the plaintiff, City of Carmel, total damages in .the sum of Seventy -Three Thousand Dollars ($73,000.00). 8. That defendants, Auditor of Hamilton County and Treasurer of Hamilton County, were properly served and have disclaimed any portion of the award entered in this cause.
