He does not feel that $500 for the several trees that are being lost is adequate. He would like for someone to come out and nark the trees that will be taken. At that point he may either want the City to replace the trees in kind or pay him to replace them. I told him that 1 would check with the City and get back to him. 11-30-12 —I spoke to Niraj Gupta. I told him that the trees were being marked today. He is on his way back from Chicago and may not be able to see them due to darkness. He is also flying out to India tonight and will be back on 12/8. He also expressed concern about their geothermal heating coil and whether it might be in the area of the easement. He said that he viewed the stakes and that there are 6 to 8 mature trees being taken and he is very upset about it and the fact that he is only getting a total of $500 for them. He said that these trees pretty much represent all the trees separating his property from his neighbors. Therefore the City is offering to increase its award for the trees by more than 600%. While this may not be entirely satisfactory to you, the City is trying to be fair with you while also being smart with the taxpayer's money. The City wanted me to stress that its counter offer is made for the purpose of trying to settle the matter only to avoid litigation, as it believes that it was proper in only offering the contributory value of $500 for the trees. The improvements include the reconstruction of the outlet from the southern pond, upsizing the existing 24" outlet pipe which drains the Larkspur subdivision, and construction of a dry detention basin on the University High School property. This dry detention basin will be connected to the northern pond by a 36" pipe and act as an overflow from the Bridlebourne subdivision to provide additional storage capacity within the system. My company, Specialized Land Services, Inc., has been hired to perform the land acquisition services for this project. In order to accommodate the planned improvements it will be necessary to acquire from you a permanent easement over 0.02 acres of land. The area of the permanent easement is a 5' strip of land that runs north and south along the property near the far -west boundary of the subject property, as shown on the attached plat and plan sheets. The 5' strip is adjacent to the existing 10' drainage, utility and sewer easement and will act as a widening of that easement. A 5' widening is also proposed on your neighbor's property. Hamilton County acting through the City of Carmel is prepared to offer you a total of $3,300.00 for the easement and trees. Of that total, $500.00 is compensation for trees located in the area of the easement and the remaining $2,800.00 is compensation for the easement. In accordance with Indiana Code (IC) 32-24-1, the offer of $3,300.00 was arrived at by an appraiser using standard appraisal methods.
