County: Hamilton Dear Mr. Britton: As you are aware, the City of Carmel is undertaking a road improvement project, which purpose is to improve N. Keystone Parkway and E. 136th Street. I have been contracted as a subconsultant by American Structurepoint, Inc., to provide buying services for this parcel. American Structurepoint, Inc., is under direct contract with the City of Carmel. Gibault Care, Inc., a corporation duly organized and existing under the laws of the State of Indiana, is reported to be the owner of record of certain property, which is affected by the improvement project. More specifically, a portion of the subject property is being acquired in fee simple with partial limitation of access. The permanent acquisition, known as Parcel 91, contains 0.529 acres, of which 0.126 acres is existing right-of-way. Pursuant to the owner's request, the City agreed to acquire to remainder of the residue west of Keystone Parkway, which is an additional 0.159 acres. The offer of $31,356.00 was arrived at by using standard appraisal methods in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP). An administrative settlement in the amount of $2,550.00 was approved forthe purchase of the remainder of the residue (0.159 acres). As you read through the enclosures, please note that the Uniform Land or Easement Acquisition Offer letter, in accordance with I.C. 32-24-1-5, provides only 30 days from its receipt to accept or reject the City's offer. The offer may be accepted or rejected now or at any time during this 30 day period. Please note that the owner's legally protected rights and options under Indiana's eminent domain law are described within the Uniform Land or Easement Acquisition Offer, as well as within the Booklet. Please review the enclosed forms and documents, which are relative to the acquisition and consist of: 1. The booklet, "ACQUISITION, Acquiring Real Property For Federal And Federal -Aid Programs and Projects"; 2. The Confirmation of Receipt of the Acquisition Booklet; 3. The Cbnfirmation of Opportunity to Accompany Appraiser on Inspection; 4. The Statement of the Basis for Just Compensation; 5. The Request for Taxpayer Identification Number and Certification (W-9 form). I will need the originals returned and for your convenience, I have enclosed a self-addressed, stamped envelope. After receiving the executed documents, I will promptly mail to you the "Receipt of Conveyance Instrument", which will serve as legal notice of the City's intent to pay you for the needed right-of-way. Typically, the City will make payment within 90 days after receiving the parcel file from the consultant. Indiana Law dictates that possession of the property will transfer to the City thirty (30) days after you have received payment. However, should the offer be unacceptable, you may submit your own appraisal for consideration by the City. If you decide to obtain your own appraisal, you do so at your own expense and submitting an appraisal does not guarantee that any change will be made in the offer. The City requested a reason as to why a Quit Claim Deed should be utilized rather than the Warranty Deed as it appears there was not a problem with their closing and the title work does not indicate any problems. I reiterated that they are to submit a counter offer for the 0.159 acres being obtained at their request. A revised plat was provided that incorporated the owner's requests. With regard to the encroachments, I explained that I have been advised that there may have been some trees trimmed or cut down by Duke however they may have the right to do so. Additionally, there were some utility contractors on site. The owner or a representative should have givenpermission for them to be there. If there are ruts or the area was disturbed, the contractor should be informed. Jeremy Kashman offered his assistance if needed as well. With regard to zoning_requirements for the maintenance of green space between the road and the property - I was advised that if the green space required by code was reduced due to the acquisition, it would not have to be replaced. With regard to the staking request - I explained that I have not been on-site recently, however it is believed that the maiority of the proposed right-of-way line has been fenced. Quit Claim Deed instead of Warranty Deed - I requested he provide a draft of a Quit Claim Deed for the City's review and consideration, Parcel 15 Limited Access Right of Way - the engineer described the entire area (Parcel 15 on the previous project as well as the two areas required for this project) as one legal description and then excepted out the area obtained for a previous project and known as Parcel 15. After the exception, the two acquisition areas required for this project are left and total 0.529 acres. It is reported to be in the flood zone and has no access to Keystone Parkway. It contains an area of 0.254 acres. The appraiser determined that Tract C's highest and best use as vacant is as an uneconomic remnant and has a value of $16,000.00 per acre. Therefore, the additional 0.159 acres x $16 000.00 equates to a rounded $2,550.00. His request for staking was forwarded to the City. I also explained that the legal description totaling 0.529 acres was attached to the email and includes the entire area west of Keystone Parkway. The proposed project was briefly discussed, specifically as it will affect the subject property. He explained that he needs to speak with a few other people to assure that the land value is fair as it seems a little low to him. Aspects of the offer packet were discussed including: 1 - The compensation includes a cost -to -cure amount totaling $5.635.00 for the relocation of fencing and a watering trough.
