WHEREAS, the foregoing Grantor having filed with the City of Cannel, Indiana ('`City"), its
Dedication and Deed of certain real property ("Property") to the City for the purpose of establishing
City rights-of-way, which Dedication and Deed is attached hereto and incorporated herein as
Exhibit "A & B" hereinabove set forth;
AND WHEREAS, the City believes that said fee simple conveyance of property is.desirable and
necessary and in the City's best interests;
NOW THEREFORE, the City, by and through its Board of Public Works and Safety, hereby

Dear Board Members:
Mr. Thomas Schmitt, Secretary and Treasurer of D. Young Chevrolet, has requested the Board sign the
Dedication of Public Right -of -Way documents as presented to the Board for approval.
These documents dedicate the right of way for 96`" Street along the southern side of the Penske
Chevrolet project, located in part of the Southeast Quarter, Section 7, Township 17 North, Range 4 East ,
Clay Township, Hamilton County, Indiana. The Department of Engineering has received construction
plans for this project. Total acreage dedicated consists of 0.179 acres.
On behalf of the City of Carmel, I would like to thank Mr. Schmitt and D. Young Chevrolet for this
dedication of Right Of Way. I recommend the Board accept and sign these documents for this
dedication.
