Mr. Jeremy Kashman PE City of Carmel 116th Street Projects (Shelburne to Towne) SCOPE OF SERVICES May 11, 2016 Project Description: The Projects will provide a multi -use path along the south side of 116th Street from Shelborne Road to Towne Road and a culvert replacement on 116th Street approximately 0.6 mile east of Shelborne Road. I. TOPOGRAPHIC SURVEY & ROUTE SURVEY The field survey will be conducted to a level detailed enough to provide adequate information to complete the final design plans for the project. The limits of the survey shall be as follows: • Starting at the southeast corner of the Shelborne Road and 116th Street roundabout and running easterly along the south side of 116th Street to the Towne Road and 116th Street intersection, approximately 5,500 lineal feet. The lateral limits of the survey shall generally extend from the centerline of 116th Street to 100' south of the centerline. Survey coverage will also include the following on the north side of 116th Street: o path termination points along West Park (4 locations) for potential tie-ins o location, size, and type of outlet pipe from West Park pond o location, size, and type of existing culvert to be replaced and 50 feet of topographic coverage to each side of culvert • Survey will include the outlet ditch from the culvert to be replaced south to its intercept with a pipe at the University High School. Survey will locate the outlet of the pipe/connection structure. Specific Scope Details & Assumptions: • Horizontal control will be completed in Indiana State Plane Coordinates East Zone 1301, and referenced to North American Datum of 1983 (NAD 83). • Vertical control will be based on Bench Mark HAM64, approximately 2.5 miles east of the project site along 116th Street. This bench mark location is based on preliminary research — if said bench mark no longer exists, this fee may need to be modified to accommodate use of an alternate monument. • PCS Engineers will have the existing utilities field marked, providing above ground evidence of the location of the utility. PCS Engineers does not guarantee the accuracy of the observed, marked utilities. The utilities will be identified by Indiana 811 and located per this survey showing horizontal location only. The depth, size, or any other features will not be noted, unless provided by the utilities. • Research the last Deed / Plat of record for the current property owners. • Along south side of 116th Street, plot all property lines obtained from deed and plat analysis and plot existing rights-of-way as determined from governing agency and subdivision plats. Lines along the north side of 116th will be based upon GIS locations only (not latest documented record). • Plot the property owner names from latest deed of record and/or GIS records. • Collect general topography within the specified survey corridor, including above ground utilities, marked below -ground utilities (horizontal locations only), wells, septic systems, sanitary sewer structures, storm sewer structures, and all existing topographic information, such as culverts, trees, fences, drives, ditches, pavement, shoulders, guardrail, toes of slopes, tops of banks, flow lines, edge of water, etc. • Detail all observed storm and sanitary structures within the survey corridor, including invert elevations, pipe direction, and sizes of pipes. Assumes a maximum of 15 structures. Does NOT include structures considered to be confined space entry. Prepare a digital terrain model (DTM) for the surveyed area. • Provide a graphical representation of an alignment for both the route survey and the design plans. This alignment will NOT include monumenting (setting points) or physically referencing the alignment in the field. • Locate and reference Section Corners and/or subdivision monuments, as required. • Prepare a field survey book complying with INDOT standards. • Prepare a Route Survey Plat and Report complying with Rule 12, Title 865 IAC. • Survey Notices will be provided to property owners along the corridor. Includes research of property ownership for mailing addresses, and assumes a total of twenty (20) owners to be notified. II. PATH DESIGN Develop design plans for a multi -use path along the south side of 116th Street, in general accordance with Carmel Clay Comprehensive Plan, including applicable drainage elements; and prepare final construction documents. Specific Scope Details & Assumptions: • Attend coordination meetings with Owner, if requested. Scope includes up to three (3) meetings during project development. • Prepare Preliminary Plans (approximately 30% complete) and documents for Owner review. • Conduct a Preliminary Field Check meeting, if requested. • Prepare Coordination Plans (approximately 60% complete) for use in utility coordination and permitting. (Not a review submittal) • Prepare Final Plans (approximately 90% complete) and documents for Owner review. • Prepare Bid Plans (100% complete) and documents. • Provide Bidding & Construction phase services as requested, including pre-bid Q&A and addenda, pre -construction meeting attendance, submittal reviews, etc. • Prepare and submit applications for project permits. Permits anticipated include Rule 5. • Scope assumes the following: o No Public Hearing is required. o Lighting, roadway, landscaping design is not required. o Traffic will be maintained on the existing roadway. No long-term roadway closures, lane closures, or detours are anticipated. o Scope includes details for a pedestrian crossing of 116th Street at West Park. Scope includes optional design of a pedestrian signal or flasher at the crossing. ■ Signal design would include details and plan sheets to be incorporated into the path construction documents. Signal design may include traffic data collection (24-hour vehicular and pedestrian counts) and/or formal Engineering Study analysis of signal warrants and needs, as determined by Owner. Signal design scope does not include any public outreach/meetings, but does include one meeting with the City during the study development. Scope assumes culvert information (plans, specifications, quantities, etc.) will be incorporated into a single bid package with the 116th Street Path. Specific Scope Details & Assumptions: • Attend coordination meetings regarding culvert design with Owner, if requested. Scope includes up to one (1) meeting dedicated to the culvert design during project development. • Calculate culvert hydrology • Determine necessary size of replacement culvert based upon design flow and hydraulic performance. • Prepare construction plan details for culvert • Determine bid quantities and cost estimates for culvert work • Prepare technical specifications related to culvert construction • Scope assumes the following: o Culvert is not a County legal drain and will not require County Drainage Board review. Scope assumes only Carmel approval will be required. o Wetland delineation is not included in this scope. Provision of wetland mitigation design is not included in this scope. o Culvert is assumed to be a pipe structure with end sections. GEOTECHNICAL SERVICES May 11, 2016 3 Provide an evaluation of the subsurface conditions and assess the impacts of these conditions on the proposed design and construction of the proposed culvert replacement. Specific Scope Details & Assumptions: • Perform two test borings at the culvert location. • Locate the test borings using measurements from existing site features shown on plans. • Contact Indiana 811 to arrange an underground utility line location check prior to geotechnical work. • Perform appropriate laboratory tests including visual soil classification, hand penetrometer readings, moisture content, and unconfined compression. • Prepare a technical report which will include a summary of findings and geotechnical recommendations. V. UTILITY COORDINATION Provide coordination of utility facility locations and any necessary adjustments to accommodate the project in accordance with 105 IAC 13. Specific Scope Details & Assumptions: • Research existing records to confirm names of utility companies with facilities in or near the project limits. • Prepare and distribute initial notice letters to all utilities known to exist in the project area. Gather responses and document utility replies. • Prepare letters requesting verification of all facilities and distribute along with preliminary project plans to all utilities known to exist in the project area. All utility replies will be documented upon receipt and all facility and/or location corrections will be noted. • Prepare and distribute conflict review letters with updated plan sheets to all utilities known to have facilities within. the project limits. All replies will be documented upon receipt. • Work Plans will be reviewed and included in plans. • Includes all required coordination during utility relocation of existing utilities or work performed in contract (if to be performed by project contractor). • Provide Utility Coordination Certification and Utility Special Provisions for bid documents. • Continue utility relocation coordination activities, as needed, until completion of construction. • This scope assumes a maximum of thirteen (13) separate utilities are located within the project impact area. • This scope assumes attendance at up to two on-site utility coordination meetings and/or project field check meetings. Pursuant to I.C. § 22-5-1.7 et seq., Vendor shall enroll in and verify the work eligibility status of all of its newly -hired employees using the E -Verify program, if it has not already done so as of the date of this Addendum. Vendor is further required to execute the attached Affidavit, herein referred to as "Exhibit C", which is an Affidavit affirming that: (i) Vendor is enrolled and is participating in the E -verify program, and (ii) Vendor does not knowingly employ any unauthorized aliens. This Addendum incorporates by reference; and in its entirety, attached "Exhibit C." (EEI) is pleased to submit the following proposal to perform a geotechnical evaluation for the referenced project. This proposal is in response to your request in an electronic message on April 11, 2016. PROJECT DESCRIPTION AND SCOPE OF SERVICES From our understanding, representatives from the city of Carmel are planning to replace an existing culvert along 116th Street between Shelbourne Road and Towne Road using local funds. Based on the request, we anticipate that the new structure will consist of a deformed pipe or box culvert, and no significant roadway improvements are anticipated. At this time, additional details of the proposed improvements such as existing/proposed grades and construction schedule are not known. The purpose of our services will be to provide an evaluation of the subsurface conditions and assess the impact of these conditions on geotechnical aspects of design. Given our involvement with other projects in the area and based on a review of geologic information, the subsurface conditions within the depth of interest are anticipated to consist primarily of cohesive soils of glacial origin with sand seams. Our scope of services is planned to include: Task 1. Performing two test borings to a depth of 20 ft each at the culvert and hand auger soundings in the flow line. The borings will be completed using truck -mounted equipment. The actual depths of the borings will be dependent on the observed conditions and forthcoming details. The borings will be advanced using 3'/ -in. I.D. hollow stem augers (AASHTO T 203) with split -spoon samples (i.e., using Standard Penetration Test procedures [AASHTO T 206]) obtained at 2%2 -ft intervals to a depth of 15 ft and at 5 -ft intervals thereafter. Furthermore, the borings will be backfilled at the completion of the field work with bentonite chips (per the city of Carmel requirements) and a pavement patch at the surface. EEI will locate the test borings using measurements from existing site features shown on plans to be provided by you. We will also contact Indiana 811 and the city of Carmel to arrange an underground utility line location check and obtain a permit, respectively; Mr. Jeffrey D. Mahan, P.E. Performing laboratory tests including visual soil classification, natural moisture content' (AASHTO T 265), Atterberg limit determinations (AASHTO T 89 and T90), hand penetrometer readings and unconfined compression tests (AASHTO T 208); and Task 3. Preparing a technical report which will include a summary of our findings and geotechnical recommendations (design and construction) for support of the proposed culvert. - SCHEDULE We are typically able to mobilize within one to two weeks after notice -to -proceed. The field work is anticipated to require one day to complete depending on weather and subsurface conditions encountered. After the field work is completed, the laboratory testing is anticipated to take approximately two to three weeks. We anticipate submitting a geotechnical report within two weeks after the laboratory work is completed for total project duration of about five to six weeks. Preliminary verbal recommendations can be provided as necessary. FEES We propose to provide our services on a time -and -expense basis in accordance with the attached General Terms and Conditions and unit rates provided on the cost estimate. With that, we estimate the cost for completing the services to be on the order of $3,630 for the geotechnical evaluation. Please recognize that the total fee is approximate because it is based on estimated quantities and the use of traffic control (flagmen) during our field activities. If any significant variation develops during the course of the evaluation, we will advise you so that our efforts can be effectively directed. CLOSURE Thank you for the continued business. GENERAL TERMS AND CONDITIONS FEES FOR PROFESSIONAL SERVICES Services will be invoiced as indicated on the attached proposal and its attached fee schedule and other attachments. ALL TIME, including travel hours, spent on the project by professional, technical and clerical personnel will be invoiced. Unless otherwise stated, any cost estimate presented in our proposal is for budgeting purposes only and is not a fixed lump -sum bid. Only those costs incurred to complete a project regardless if they are less or greater than the cost estimates will be invoiced unless prior written notification is received to stop work. If it is apparent that the budgetary estimate is not sufficient to complete the project in a satisfactory manner, the client will be advised as soon as practical. Earth Exploration, Inc. (EEI) reserves the right to escalate the rates on time and material contracts to account for increases in its direct or indirect costs, if work extends beyond the 365 calendar days from the date of the authorization to proceed. SCOPE OF WORK AND TIME LIMIT The attached proposal is valid for a period of 60 days from the proposal date. The scope of work is as identified in the proposal. If acceptance and authorization to proceed with the work is not received within 60 days, EEI reserves the right to renegotiate the estimated costs, schedule for completion, personnel commitments, and overall scope of work. EEI reserves the right to renegotiate the proposal should the client choose. to alter the scope of work from that presently indicated in the proposal. III. RIGHT OF ENTRY Unless otherwise agreed, the client will fumish right -of -access on the land for EEI to perform the required explorations or other necessary investigations. EEI will take reasonable precautions to minimize damage to the land from use of equipment, but has not included in the fee the cost for restoration of damage which may result from our operations. If the client desires EEI to restore the land to its former condition, this will be accomplished, and the cost will be added to the fee. IV. UTILITIES In the performance of our work, EEI will take all reasonable precautions to avoid damage or injury to subterranean structures or utilities. The client agrees to hold EEI harmless for any damages to subterranean structures which are not called to our attention and correctly shown on any plans furnished. INVOICES AND PAYMENTS Invoices will be submitted once a month and payment is due Net 30 Days from date on the invoice. A 1% percent per month service charge will be added to all accounts more than 30 days past due. In the event that EEI shall be successful in any suit for damages for breach of this agreement, including nonpayment of invoices, or to enforce this agreement or to enjoin the other party from violating this agreement, EEI shall be entitled to recover as part of its damages its reasonable legal costs and expenses for bringing and maintaining any such action. SAMPLES All samples of soil and rock, which remain after testing, will be discarded 60 days after submission of our report unless otherwise directed by the client Upon request, we will deliver samples to the client, shipping charges collect on delivery, or we will store them for an agreed charge. Within the limits of said insurance, we agree to save the client harmless from and against loss, damage, injury, or liability arising directly from the negligent acts or omissions of ourselves, our employees, agents, subcontractors, and their employees and agents. If the client's contractor purchase order places greater responsibility upon EEI, or requires further insurance coverage, we if specifically directed by the client, will obtain additional insurance (if procurable), at the client's expense; but we shall not be responsible for property damage for any cause, including fire and explosion, beyond the amount and coverage of our insurance. In addition, we require that EEI be named as an additional insured in any hold -harmless agreements against third party suits between the client or owner and any contractor who may perform work in connection with any study or report prepared by EEI. VIII. STANDARD OF CARE Our professional services will be conducted in a manner consistent with the level of care and skill ordinarily exercised by members of the geotechnical engineeringlenvironmental services profession practicing contemporaneously under similar conditions in the locality of the project. Under no circumstance is any warranty, expressed or implied, made in connection with the providing of geotechnical engineering/environmental services. IX. LIMITATION OF PROFESSIONAL LIABILITY The client agrees to limit any and all liability or claim damages, costs of defense, or expenses to be levied against EEI, to a sum not to exceed $50,000, or the amount of our fee, whichever is greater, on account of any design defect, error, omission, or professional negligence. Further, the client agrees to notify any contractor or subcontractor who may perform work in connection with any design, report, or study prepared by EEI of such limitation of liability for design defects, errors, omissions, or professional negligence, and requires as a condition precedent to their performing the work alike limitation of liability of their part as against EEI. In the event that the client fails to obtain a like limitation of liability provision as to design defects, errors, omissions, or professional negligence, availability of the client and EEI, to such contractor or subcontractor arising out of a design defect, error, omission, or professional negligence, shall be allocated between the client and EEI in such a manner that the aggregate liability of EEI for such a design defect to all parties, including the client, shall not exceed $50,000 or the amount of our fee, whichever is greater. X. SAFETY Any construction review of the contractor's performance conducted by EEI is not intended to include review of the adequacy of the contractor's safety measures in, on, or near the construction site. The contractor will be solely and completely responsible for working conditions of the job site, including safety of all persons and property during performance of the work. This requirement will apply continuously and not be limited to normal working hours. XI. PROPRIETARY INFORMATION The ideas or other information contained in the proposal may be proprietary and shall not be disclosed to any parties outside of the client's representative or owner, or be duplicated, used, or disclosed in whole or part for any purpose other than to evaluate the proposal. Should the proposal be accepted, the client shall have the right to duplicate, use, or disclose to the extent provided through a written agreement with EEI.
