Engineering - 2017 Appropriation: 94-650.04, COIT Bond Fund; P.O. 100075 Contract Not To Exceed $91,713.00 AGREEMENT FOR PROFESSIONAL SERVICES THIS AGREEMENT FOR PROFESSIONAL SERVICES ("Agreement") is hereby made and entered into by and between the City of Carmel, Indiana, acting by and through its Board of Public Works and Safety (hereinafter "City"), and Midwest Geosciences Group, Inc. (hereinafter "Professional"). RECITALS WHEREAS City owns and is responsible for the operation and maintenance of its property, personnel, public works and infrastructure; and and WHEREAS, from time to time, City needs professional assistance in fulfilling its foregoing responsibilities; WHEREAS, Professional is experienced in providing and desires to provide to City the professional services ("Services") referenced herein; and WHEREAS, City desires to engage Professional as an independent contractor for the purpose of providing to City the Services referenced herein; NOW, THEREFORE, in consideration of the foregoing recitals and the covenants and conditions set forth herein, City and Professional mutually agree as follows: SECTION 1 INCORPORATION OF RECITALS The foregoing Recitals are hereby incorporated into this Agreement and made a part hereof. SECTION 2 SCOPE OF SERVICES 2.1 City desires to engage Professional as an independent contractor for the Services set forth in attached Exhibit A, incorporated herein by this reference. 2.2 Professional understands and agrees that City may, from time to time, request Professional to provide additional or modified Services to City. When City desires additional Services from Professional, the City shall notify Professional of such additional Services desired, as well as the time frame in which same are to be provided. Only after City has approved Professional's time and cost estimate for the provision of such additional Services, has encumbered sufficient monies to pay for same, and has authorized Professional, in writing, to provide such additional Services, shall such Services be provided by Professional to City. A copy of the City's authorization documents for the purchase of additional Services shall be numbered and attached hereto in the order in which they are approved by City. 2.3 Time is of the essence of this Agreement. Engineering - 2017 Appropriation: 94-650.04, COIT Bond Fund; P.O. 100075 Contract Not To Exceed $91,713.00 SECTION 3 CITY'S RESPONSIBILITIES 3.1 City shall provide such information as is reasonably necessary for Professional to understand the Services requested. 3.2 City shall provide all data required for provision of Services. Professional may assume that all data so provided is correct and complete. 3.3. City shall arrange for Professional to enter upon public and private property as reasonably required for Professional to perform the Services. 3.4 City shall designate payment of the Services from City budget appropriation number 94-650.04 funds. 3.5 City shall designate the Mayor or his duly authorized representative to act on City's behalf on all matters regarding the Services. SECTION 4 PROFESSIONAL'S RESPONSIBILITIES 4.1 Professional shall perform the Services pursuant to the terms of this Agreement and within any applicable time and cost estimate. 4.2 Professional shall coordinate with City its performance of the Services. 4.3 Professional shall provide the Services by following and applying at all times reasonable and lawful standards as accepted in the industry. SECTION 5 COMPENSATION 5.1 Professional estimates that the total price for the Services to be provided to City hereunder shall be no more than Ninety One Thousand Seven Hundred Thirteen Dollars ($91,713.00) (the "Estimate"). Professional shall submit an invoice to City no more than once every thirty (30) days for Services provided City during the time period encompassed by such invoice. Invoices shall be submitted on a form containing the same information as that contained on the Professional Services Invoice attached hereto as Exhibit B, incorporated herein by this reference. Engineering - 2017 Appropriation: 94-650.04, COIT Bond Fund; P.O. 100075 Contract Not To Exceed $91,713.00 SECTION 6 TERM Unless otherwise terminated in accordance with the termination provisions set forth in Section 7.1 hereinbelow, this Agreement shall be in effect from the Effective Date through December 31, 2017, and shall, on the first day of each January thereafter, automatically renew for a period of one (1) calendar year, unless otherwise agreed by the parties hereto. SECTION 7 MISCELLANEOUS 7.1 Termination 7.1.1 The obligation to provide all or any portion of the Services under this Agreement may be terminated by City or Professional, without cause, upon thirty (30) days' notice. 7.1.2 The obligation to provide all or any portion of the Services under this Agreement may be terminated by City, for cause, immediately upon Professional's receipt of City's "Notice To Cease Services." 7.1.3 In the event of full or partial Agreement termination, and as full and complete compensation hereunder, Professional shall be paid for all such Services rendered and expenses incurred as of the date of termination that are not in dispute, except that such payment amount shall not exceed the Estimate. Disputed compensation amounts shall be resolved as allowed by law. 7.2 Binding Effect City and Professional, and their respective officers, officials, agents, partners and successors in interest are bound to the other as to all Agreement terms, conditions and obligations. 7.3 No Third Party Beneficiaries Nothing contained herein shall be construed to give rights or benefits to anyone other than the parties hereto. 7.4 Relationship The relationship of the parties hereto shall be as provided for in this Agreement, and neither Professional nor any of its agents, employees or contractors are City employees. Professional shall have the sole responsibility to pay to or for its agents, employees and contractors all statutory, contractual and other benefits and/or obligations as they become due. Professional hereby warrants and indemnifies City for and from any and all costs, fees, expenses and/or damages incurred by City as a result of any claim for wages, benefits or otherwise by any agent, employee or contractor of Professional regarding or related to the subject matter of this Agreement. Engineering - 2017 Appropriation: 94-650.04, COIT Bond Fund; P.O. 100075 Contract Not To Exceed $91,713.00 7.5 Insurance Professional shall procure and maintain with an insurer licensed to do business in the State of Indiana such insurance as is necessary for the protection of City and Professional from all claims under workers' compensation, occupational disease and/or unemployment compensation acts, because of errors and omissions, because of bodily injury, including, but not limited to, the personal injury, sickness, disease, or death of any of Professional's employees, agents or contractors and/or because of any injury to or destruction of property, including, but not limited to, any loss of use resulting therefrom. The coverage amounts shall be no less than those amounts set forth on attached Exhibit C. Such insurance policies shall not be canceled without thirty (30) days' prior written notice to City. 7.6 Liens Professional shall not cause or permit the filing of any lien on any of City's property. In the event such a lien is filed and Professional fails to remove it within ten (10) days after the date of filing, City shall have the right to pay or bond over such lien at Professional's sole cost and expense. 7.7 Default In the event Professional: (a) repudiates, breaches or defaults under any of the terms or conditions of this Agreement, including Professional's warranties; (b) fails to perform the Services as specified; (c) fails to make progress so as to endanger timely and proper completion of the Services and does not correct such failure or breach within five (5) business days after receipt of notice from City specifying same; or (d) becomes insolvent, files, or has filed against it, a petition for receivership, makes a general assignment for the benefit of creditors or dissolves, each such event constituting an event of default hereunder, City shall have the right to terminate all or any part of this Agreement, without liability to Professional and to exercise any other rights or remedies available to it at law or in equity. 7.8 Government Compliance Professional agrees to comply with all laws, executive orders, rules and regulations applicable to Professional's performance of its obligations under this Agreement, all relevant provisions of which being hereby incorporated herein by this reference, to keep all of Professionals' required professional licenses and certifications valid and current, and to indemnify and hold harmless City from any and all losses, damages, costs, liabilities, damages, costs and attorney fees resulting from any failure by Professional to do so. This indemnification obligation shall survive the termination of this Agreement. 7.9 Indemnification Professional shall indemnify and hold harmless City and its officers, officials, employees and agents from all losses, liabilities, claims, judgments and liens, including, but not limited to, all damages, costs, expenses and attorney fees arising out of any intentional or negligent act or omission of Professional and/or any of its employees, agents or contractors in the performance of this Agreement. This indemnification obligation shall survive the termination of this Agreement. Engineering - 2017 Appropriation: 94-650.04, COIT Bond Fund; P.O. 100075 Contract Not To Exceed $91,713.00 7.10 Discrimination Prohibition Professional represents and warrants that it and each of its employees, agents and contractors shall comply with all existing and future laws prohibiting discrimination against any employee, applicant for employment and/or other person in the subcontracting of work and/or in the performance of any Services contemplated by this Agreement with respect to hire, tenure, terms, conditions or privileges of employment or any matter directly or indirectly related to employment, subcontracting or work performance hereunder because of race, religion, color, sex, handicap, national origin, ancestry, age, disabled veteran status or Vietnam era veteran status. This indemnification obligation shall survive the termination of this Agreement. 7.11 E -Verify Pursuant to I.C. § 22-5-1.7 et seq., Professional shall enroll in and verify the work eligibility status of all of its newly -hired employees using the E -Verify program, if it has not already done so as of the date of this Agreement. Professional is further required to execute the attached Affidavit, herein referred to as Exhibit D, which is an Affidavit affirming that: (i) Professional is enrolled and is participating in the E -verify program, and (ii) Professional does not knowingly employ any unauthorized aliens. This Addendum incorporates by reference, and in its entirety, attached Exhibit D. In support of the Affidavit, Professional shall provide the City with documentation that it has enrolled and is participating in the E -Verify program. This Agreement shall not take effect until said Affidavit is signed by Professional and delivered to the City's authorized representative. Should Professional subcontract for the performance of any work under this Addendum, the Professional shall require any subcontractor(s) to certify by affidavit that: (i) the subcontractor does not knowingly employ or contract with any unauthorized aliens, and (ii) the subcontractor has enrolled and is participating in the E -verify program. Professional shall maintain a copy, of such certification for the duration of the term of any subcontract. Professional shall also deliver a copy of the certification to the City within seven (7) days of the effective date of the subcontract. If Professional, or any subcontractor of Professional, knowingly employs or contracts with any unauthorized aliens, or retains an employee or contract with a person that the Professional or subcontractor subsequently learns is an unauthorized alien, Professional shall terminate the employment of or contract with the unauthorized alien within thirty (30) days ("Cure Period"). Should the Professional or any subcontractor of Professional fail to cure within the Cure Period, the City has the right to terminate this Agreement without consequence. The E -Verify requirements of this Agreement will not apply, should the E -Verify program cease to exist. 7.12 Severability If any provision of this Agreement is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be stricken, and all other provisions of this Agreement that can operate independently of same shall continue in full force and effect. Haney Corporation Counsel One Civic Square Carmel, Indiana 46032 Notwithstanding the above, City may orally provide to Professional any notice required or permitted by this Agreement, provided that such notice shall also then be sent as required by this paragraph within ten (10) business days from the date of such oral notice. 7.14 Effective Date The effective date ("Effective Date") of this Agreement shall be the date on which the last of the parties hereto executes same. 7.15 Governing Law: Lawsuits This Agreement shall be governed by and construed in accordance with the laws of the State of Indiana, except for its conflict of laws provisions, as well as by all ordinances and codes of the City of Carmel, Indiana. The parties agree that, in the event a lawsuit is filed hereunder, they waive any right to a jury trial they may have, agree to file such lawsuit in an appropriate court in Hamilton County, Indiana only, and agree that such court is the appropriate venue for and has jurisdiction over same. 7.16 Waiver Any delay or inaction on the part of either party in exercising or pursuing its rights and/or remedies hereunder or under law shall not operate to waive any such rights and/or remedies nor in any way affect the rights of such party to require such performance at any time thereafter. Engineering - 2017 Appropriation: 94-650.04, COIT Bond Fund; P.O. 100075 Contract Not To Exceed $91,713.00 7.17 Non -Assignment Professional shall not assign or pledge this Agreement nor delegate its obligations hereunder without City's prior written consent. 7.18 Entire Agreement This Agreement contains the entire agreement of and between the parties hereto with respect to the subject matter hereof, and no prior agreement, understanding or representation pertaining to such subject matter, written or oral, shall be effective for any purpose. No provision of this Agreement may be amended, added to or subtracted from except by an agreement in writing signed by both parties hereto and/or their respective successors in interest. To the extent any provision contained in this Agreement conflicts with any provision contained in any exhibit attached hereto, the provision contained in this Agreement shall prevail. 7.19 Representation and Warranties Each party hereto represents and warrants that it is authorized to enter into this Agreement and that any person or entity executing this Agreement on behalf of such party has the authority to bind such party or the party which they represent, as the case may be. 7.20 Headings All headings and sections of this Agreement are inserted for convenience only and do not form a part of this Agreement nor limit, expand or otherwise alter the meaning of any provision hereof. 7.21 Advice of Counsel The parties warrant that they have read this Agreement and fully understand it, have had an opportunity to obtain the advice and assistance of counsel throughout the negotiation of same, and enter into same freely, voluntarily, and without any duress, undue influence or coercion. 7.22 Copyright City acknowledges that various materials which may be used and/or generated by Professional in performance of Services, including forms, job description formats, comprehensive position questionnaire, compensation and classification plan and reports are copyrighted. City agrees that all ownership rights and copyrights thereto lie with Professional, and City will use them solely for and on behalf of its own operations. City agrees that it will take appropriate action with its employees to satisfy its obligations with respect to use, copying, protection and security of Professional's property. 7.23 Personnel Professional represents that it has, or will secure at its own expense, all personnel required in performing the services under this agreement. Such personnel shall not be employees of or have any contractual relationship with City. All of the services required hereunder will be performed by Professional or under his supervision and all personnel engaged in the work shall be fully qualified to perform such services. City shall have free access at all proper times to such records and the right to examine and audit the same and to make transcripts there from, and to inspect all program data, documents, proceedings and activities. 7.25 Accomplishment of Project Professional shall commence, carry on, and complete the project with all practicable dispatch, in a sound economical and efficient manner, in accordance with the provisions thereof and all applicable laws. In accomplishing the project, Professional shall take such steps as are appropriate to ensure that the work involved is properly coordinated with related work being carried on within City's organization. 7.26 Iran Certification Pursuant to I.C. § 5-22-16.5, the Professional shall certify that, in signing this Agreement, it does not engage in investment activities within the Country of Iran. 7.27 Access to Public Records Act Professional understands and agrees that any "public record", as that term is defined in Indiana Code 5-14-3- 2(m), as amended, that is related to the subject matter of this Agreement, whether the same is in the possession or control of the Professional or the City, shall be subject to release under and pursuant to the provisions of Indiana's Access to Public Records Act, as codified in Indiana Code 5-14-3-1, et s�Mc., as amended. The project is being undertaken because the existing 69 -kV circuit is located overhead on wood pole structures and the OWNER is relocating the 69 -kV circuit underground to facilitate proposed development. This Proposal confirms' 'our understanding of the Technical Guidelines prepared by Burns and McDonnell for the Cityof Carmel and Duke Energy. Plus, we've added more specifics about how we build upon the Technical Guidelinesthrough our approach to characterize the geologic setting as well as the geotechnical testing and de- sign. Our proposal outlines the tasks to be performed, identifies ways to manage expected uncertainties, and the value-added edge by selecting Midwest GeoSciences Group, Inc. for the work. Selecting Midwest GeoSciences Group for this project brings added value by adding special technical expertise and communications skills required for this proj ect: GEOSCIENCES :vvw.r�tdresty7o7071 gt'OUp Technical Expertise. The Technical Guidelines for the proposal indicate expected uncertainty about subsurface conditions along the proposed relocation route. Review of Available Literature Regarding Subsurface Conditions 2. Soft Dig Techniques Prior to Drilling to Verify Clearances of Subsurface Utilities and Structures 3. Subsurface Exploration Program A. Utility Clearance B. Traffic Control C. Borehole Logging by an experienced geologist or geotechnical engineer D. Site Restoration E. Applicable Standards F. Borings G. Boring Methods H. Soil and Rock Sampling 4. Geothermal Sampling and Testing 5. Field Resistivity Survey 6. Laboratory Testing of Soil and Rock 7. Subsurface Investigation and Geotechnical Report Midwest Geosciences Group will review available geological publications and data for the site area, identifying any pertinent information regarding the ge- ology, geotechnical data, water resources, geologic hazards, and other infor- mation that will assist in helping understand subsurface conditions at the site. Pertinent information will be included in the Subsurface Investigation and Geotechnical Report. Safety and the preservation of existing structures are fundamental concerns. To begin each boring, soft dig techniques using a Hydro -Vac or similar procedure will be used to start the hole to a depth of 2 to 3 feet to check for undetected utilities or buried objects. Drilling will then proceed with caution while collecting samples. Costs for Soft Dig Techniques are included in our drilling subcontractor's bid. There are several aspects to the subsurface exploration program: coordination of utility clearance, coordination of traffic control, full-time borehole logging by an experienced geologist or geotechnical engineer, site restoration involv- ing patching asphalt or concrete on completion of drilling, applicable stand- ards, boring schedule, boring methods, and soil and rock testing. Utility Clearance Midwest GeoSciences Group will be responsible for seeing that utility clear- ance is completed prior to any subsurface investigation. B. Traffic Control Traffic safety and minimizing disruption are among the highest priority. Midwest GeoSciences Group will coordinate traffic control for this field in- vestigation. C. Borehole Logging by an Experienced Geologist A professional geologist experienced with the geology of Carmel, IN will log the borings and document geotechnical measurements in the field using N - values from Standard Penetration Testing, compressive strength using a standard pocket penetrometer, and shear strength using a Torvane Tester. P. Site Restoration Upon completion of the drilling, asphalt or concrete will be patched to meet the existing pavement type. We comply with the CITY restoration requirements in order to maintain the beauty of the city both during and after work completion. Our field approach is efficient and tidy in order to minimize drilling duration while giving public courtesy. E. Applicable Standards Work be completed to the standards presented in the project's Technical Guidelines. Midwest GeoSciences Group will complete all work related to the drilling, logging, and sampling of soil and rock, and all field and laborato- ry testing, in accordance with ASTM Standards. In addition, standards refer- enced in "Methods of Soil Analysis, Part 2, Chemical and Microbiological Properties," Number 9 in Agronomy Series will be followed for (1) Soluble Sulfates by the BaC12 Titration Method, and (2) Chloride Ion by Silver Nitrate Titration Method. F. Borings Borings will be completed at locations given in Table 1, Boring Schedule, provided in the Technical Guidelines. Surveying shall be completed by others and shall not be a part of Midwest GeoSciences scope of work. The CITY will provide right-of-way activity permit for the subsurface exploration and Midwest GeoSciences Group will adhere to the conditions of that permit. Midwest Geosciences Group will also be responsible for determin- ing locations of utilities in the vicinity of the actual test locations with OWN- ER, CITY, and other local agencies. Boring locations may be adjusted in the field to avoid utilities, overhead ob- structions, or to permit easier access, provided approval of OWNER. If ap- proved, the final location shall be noted on the boring log. Offsets shall not ex- ceed 15 feet from the original location unless approved in advance by the OWNER. When a test location is offset from the proposed location, the offset boring shall be surveyed. Midwest GeoSciences Group will note the elevation on each boring log. Each boring shall be advanced to a minimum penetration in the soil as defined above or to auger refusal in bedrock. At this time, it is not anticipated that bed- rock will be encountered. If necessary, Midwest GeoSciences Group will per- form deepened borings to prevent termination of the borings in unacceptably soft clay or loose sand deposits. Identifying and Managing Uncertainties As noted in the Technical Guidelines for the project, additional borings, deep- ened borings, test pits, cone penetrometer soundings, in-situ testing, or other investigation techniques may be required to provide the information requested in the Report. Timely recognition and action can minimize the impact to changes in budget and schedule. G. Boring Methods Our cost estimate is based on the collecting samples at 2.5 feet intervals down to 10 feet and 5 feet intervals hereafter, the scope provided in the project Technical Guidelines. Our professional geologist will personally log the boring in the field using ASTM D2488 combined with the key additional - descriptive elements to take the mystery out of the subsurface. He will characterize the geologic framework and document geotechnical measurements in the field using N -values from the Standard Penetration Testing, compressive strength using a standard pocket penetrometer, and shear strength using a Torvane Tester. Sample quality is paramount. Borings will be advanced with drilling methods that minimize the potential for disturbance, sloughing, or mixing of materials within soil samples. If water is encountered in cohesionless material within a borehole, rotary wash drilling methods with bentonite or polymer slurry will be used in which positive head is maintained within the hole. Water levels en- countered as well as the drilling method will be indicated on boring logs or within the Report. If necessary, Midwest GeoSciences Group will perform deepened borings to prevent termination of the borings in unacceptably soft clay or loose sand de- posits. Unless otherwise specified by the OWNER, the minimum required soil or rock strength to terminate borings BMcD B1, BMcD B2, BMcD B7, and i BMcD B 11 at the designated minimum boring depth shall be as follows: a. Standard Penetration Test, N > 8 b. Cohesion, c > 1000 psf based on calibrated hand penetrometer, torvane or field vane shear test Upon completion"of drilling and water -level measurement, boreholes will be backfilled in general accordance with the specific requirements of applicable federal, state, and local agencies. Based on the anticipated low -permeability glacial deposits, Midwest GeoSciences Group proposes using a High Solids Mix Ratio or Bentonite for borehole sealing. Both Barroid and CETCO manufacturer's specifications exhibit a hydraulic conductitity of 10E-08 cm/sec when mixed properly which will prevent water from moving vertically in the borehole. Proper borehole sealing and documentation protects the CITY from liabilities related to downward movement of ground water through the borehole into a buried sand -and -gravel aquifer, if encountered. Borings shall be patched in accordance with the overlying pavement type. We understand that contamination is not expected at any of the boring locations for this project. However if we observe contamination in a boring, we will immediately notify the CITY while capturing the drill cutting and drill fluids in a dedicated drum for removal and disposal to an off-site location at the direction of the CITY. Costs associated with encountering contaminated soils are not included in this proposal. Bedrock is not indicated within 50 of the ground surface in regional mapping, and we do not expect to encounter bedrock in any borings. However, if bedrock should be encountered, rock coring in competent bedrock will be completed using NX -size, double -tube rock coring techniques. Detailed rock core descriptions will include information regarding rock type, rock formation, degree of hardness, extent of weathering, percentage of recovery, and Rock Quality Designation (RQD) values. Unit prices for rock coring are included in the proposal cost estimate. Identifying and Managing Uncertainties The Technical Guidelines call for Standard Penetration Test (SPT) sampling of cohesionless soils (sands, gravels, and non -plastic silts) and Thin -Walled Tube sampling of cohesive soils (clays and plastic silts). The problem with this sampling is that there is no advance knowledge of whether the soils to be encountered will be cohesionless or cohesive. Furthermore, it is not possible to know what soil types occur within Thin -Walled Tubes. To solve these problems, Midwest GeoSciences Group proposes the following two-step common-sense approach: • Do an initial pilot boring using continuous SPT techniques to identify the subsurface soils and sequence. • Sample targeted cohesive soil intervals in a second boring using the Thin -Walled Tube sampling method. This ensures — without a doubt - that the subsurface materials are correctly identified, sampled and properly tested to meet project objectives. Bottom line: we execute what Technical Guidance document stipulates which is conducting tests that are rationale to the site stratigraphy instead of just blindly collecting samples according a random depth. Sampling intervals specified in the Technical Guidelines call for samples at 2.5 feet intervals down to 10 feet and 5 feet intervals beyond the 10 feet depth. Interval sampling creates uncertainty. Boundaries between geologic materials and formations can be missed; thin units, such as a thin outwash sands that may cause groundwater inflow into excavations and excavation instability, might be missed. We think on our feet in the field, synthesizing what we encounter in the field — not collecting data for later analysis in the office. On-site technical decision making is a critical element of this project and we are capable of bringing these skills to the CITY by providing seasoned field staff for the project. For example, we routinely prepare field diagrams during the drilling program to provide a rationale for geotechnical sample collection and testing that considers both site stratigraphy and foundation depths instead of random selections based on depth or spacing alone. This in- field QA/QC system benefits projects by allowing client participation in decision making on a daily basis as they have the opportunity to evaluate as the field investigation progresses. Our approach is developing a stratigraphic framework to evaluate the distribution of subsurface glacial deposits and the ground water movement through them. Familarity with Local and Regional Geology Midwest GeoSciences is headquartered in Carmel, IN and well acquainted with the geology of the city and region. c. Collaboration with the Indiana Geological Survey nsThe Midwest GeoSciences Group, Inc. has collaborated with the Indiana Geological Survey for over 15 years. For example, Clay Terrace in Carmel was the location of a public educational event in June 2016 conducted by Midwest GeoSciences Group. Assistance from Dr. Henry Loope from the IGS offered the residents of Carmel a up -close -and -personal look at the geologic history and glacial stratigraphy beneath the City of Carmel. Our drilling and boring log information was used as a model for high- quality soil descriptions. The IGS showcased our work and added it into the regional geologic mapping framework as a "smart hole" to enhance the understanding of state-wide units. d. As a consequence, they include additional information such as the geologic material, formation, and sedimentary structure, properties that are essential to identifying and understanding subsurface geologic units. Field Documentation as an Integral Part of QA/QC The role of the field geologist includes maintaining all field documentation such as daily time logs, daily drilling summaries, boring logs, grout batch records, and any other project -specific documentation such as health and safety documentation, borehole decommissioning forms, etc. Midwest GeoSciences Group excels at comprehensive field documentation. While all pertinent forms are completed in the field, we believe in comprehensive field documentation because (1) it acts as a checklist for field personnel so that important procedures are not overlooked; (2) it documents the procedures and materials used and encountered for the project that and makes that information available for client and regulatory agency review; and (3) it provides an historical record that can be referenced anytime in the future as the if materials and procedures need to be known. f. Field Testing Midwest GeoSciences Group commonly tests Unconfined Compressive Strength (Qu) using a series of pocket penetrometer measurements and Directional Shear Strength (Su) using a Torvane Shear Tester. These field tests are standard for our work, do not require extra time, and are provided free of charge —and bring additional value in addition to the N -values recorded from Standard Penetration Testing. Both Qu and Su values are documented on the field boring log and transferred to the Final Boring Logs. Borehole Backfill Decommissioning Midwest GeoSciences Group concurs with the borehole sealing requirements outlined in the City of Carmel Wellhead Protection Ordinance. Experience has shown that borehole backfill (decommissioning) is a very important element for protecting ground water. Midwest GeoSciences Group is a leader in the industry in understanding and documenting borehole decommissioning for environmental and engineering projects. We understand the CITY stresses best practices for borehole decommissioning too. Both the CITY and Midwest GeoSciences Group advocate using the same effective approach for sealing boreholes. We suggest using a high solids mix ratio pumped in slurry form. We in turn, field verify that every mix ratio is properly prepared by measuring water and grout mix coupled with weighing each mixed batch with a scale to ensure specified density. We measure and record each grout batch on the Borehole Decommissioning Record. The benefit of proper borehole sealing is protecting the ground water and the priceless aquifers we depend on for drinking water — we do not short-cut this important project attribute. g. Health and Safety Procedures Safety extends beyond the limits of our work boundary. We are responsible for the general safety of workers during the project and we protect the public from project hazards. A Health and Safety plan will be developed and ready prior to work commencing. The H&S plan will include a hazard analysis and will be reviewed daily during pre -work meetings. All personnel conducting drilling activities will be qualified in proper drilling and safety procedures. We will adhere to special safety requirements related to work access areas and are courteous to all public spectators. The drilling rig and associated field equipment will be checked periodically to ensure it is in working order. Daily inspections will be documented on Daily Time Logs. h. Security, Site Access and Other Special Issues Safety becomes number one priority so we create a safe zone around our work area that alerts us when the public is approaching the work zone — we keep them in the public area. We politely welcome any visitors however we refer questions about the project to the CITY. Prior to commencement of drilling activities, we steam clean all drill rig equipment. Drilling will occur in areas that have no known contamination, so standard equipment cleaning is expected to be sufficient between locations. Cleaning will not occur at the drilling location in order to aid site restoration and to avoid unnecessary containment of wash fluids. We shall obtain and conform to all permits required to perform this scope of work on CITY property. Soil and Rock Sampling 69kV Underground Relocation Project Subsurface sampling will be conducted following the Technical Guidelines. Standard Penetration Testing will be used to obtain samples at 2.5 feet intervals down to 10 feet and 5 feet intervals beyond by the following methods: a. Split -Barrel Sampler (SPT) or Ring -Lined Barrel Sampling in cohesionless soils (sands, gravels, non -plastic silts), and cohesive soils (clays and plastic silts) where a disturbed sample is appropriate or a Shelby tube cannot be obtained (hard soils); D 1586 or D3550. b. Thin -Walled Tube (Shelby) in cohesive soils (clays, plastic silts and materials with cohesive binder); D 1587. c. Samples for geotherm analysis will be collected in accordance with specifications in the Technical Guidelines. d. Bulk samples of the near -surface materials will be collected for compaction testing. e. If applicable, continuous rock core samples will be obtained and stored in core boxes in accordance with ASTM D2113. Digital photographs of each core box will be taken for inclusion in the Report. Midwest GeoSciences Group routinely provides blow count correction to obtain standard N60 value. Boring logs will include information on the type of hammer (rope and cathead, or auto hammer) and relative energy. Identifying and Managing Uncertainties As previously noted under SubSection G, Boring Methods, Midwest GeoSciences Group recommends adjusting the scope described in the Technical Guidance document from interval sampling to continuous sampling. Continuous sampling minimizes uncertainty about the geology, and allows a more reliable target with the Thin -Walled Tube sampling of cohesive soils (clays and plastic silts) in a second boring dedicated specifically for geotechnical sample collection. testing. The Technical Guidance did not specify use of either the Wenner Array or a Schlumberger Array for the field resistivity survey, but we are prepared to con- duct the survey using either approach upon preference from the ENGINEER. We understand the designated field resistivity surveys will be conducted near bor- ings BMcD B-5 and BMcD B-10 as shown on the attached Boring Location Plan. The survey shall be completed in an area that is not influenced by the presence of overhead EHV transmission lines, underlying storage facilities, underground utili- ties or other obstructions that would impact the results of the survey. Upon field inspection for this Proposal, the pavement will not allow intrusive ground arrays to penetrate the subsurface and there is likely going to be interference in the precise designated areas of borings BMcD B-5 and BMcD B- 10. However we propose simply moving the array slightly to achieve task objectives. We have continued to maintain this work effort in this proposal and includes cost for it in the budget estimate.. The Survey is intended to be conducted along two (2) perpendicular lines (N -S and E -W) centered at the boring locations. For each line, readings will be taken with "a" spacings of 2.5, 5, 10, 20 and 50 feet. The values reported for each "a" -spacing shall include current, potential, and apparent resistivity, reported in Ohm -cm. If there are too many obstructions to complete the full testing, a -spacings may be reduced, if reduced spacing is not feasible then a single N/S or E/W transverse can be completed. If there are too many obstructions or insufficient space to conduct a field resistivi- ty test, laboratory soil testing for resistivity shall be completed instead. Subsurface Conditions We will report the subsurface conditions encountered at the site. Figure(s) showing soil borings, geothermal testing results and generalized cross section(s) will be prepared. A general description of the engineering properties or parameters determined from the investigation will be made and project and foundation recommendations will be provided. Prevailing groundwater elevations observed and those recommended for design will be noted. 2. Geologic Hazards We will provide a discussion of the potential geologic hazards in the vicinity of the site which may impact the project; including fault rupture, landslides, dispersive or collapsible soils, flooding, and other as applicable to the site. An evaluation of the applicable geologic hazards shall be made and special design features required to resist or reduce these tendencies shall be discussed. We will evaluate the expansive (swelling) nature of subgrade materials and special design features required to resist or reduce these tendencies. If soils present at the site are shown to exhibit expansive characteristics, we will perform a sufficient number of swell/collapse potential tests to adequately characterize the site's active zone. 3. Seismic Hazards We will perform a review of seismic hazards and provide recommendations to address the following seismic design parameters in accordance with applicable provisions of IBC (2012) and ASCE7-10. 4. Previous Construction Activity We will provide a discussion of previous construction activity and address any existing fills or subsurface openings, if applicable. We will outline the engineering properties of any existing fills in regard to installation of the ductbanks, placement of vaults, and foundation design. 5. Earthwork Recommendations We will provide general criteria and recommendations for acceptable fill and backfill materials (general and structural fill). If overexcavation of unsuitable materials and structural backfill appear warranted, we will provide vertical and horizontal extent of the over excavation and structural backfill. This may require additional work not included in this proposal. Foundation Design We understand the Subsurface Investigation and Geotechnical Report will be used by the ENGINEER for design and sizing of stable foundations for proposed structures and to estimate foundation costs. We will include generalized factors of safety utilized in developing the allowable load capacities. We understand the only anticipated structures at this time are the riser monopoles. We understand these poles will either be direct embed or drilled shaft foundations. We will provide design parameters for deep foundations that include ultimate skin friction and end bearing values for compression and uplift for each soil or rock stratum encountered. We will provide appropriate factors of safety to utilize in design. For each layer of the stratigraphic profile, we will provide lateral design parameters for use in the computer program LPILE v2015 (Matlock and Reese). At a minimum, we will provide LPILE design parameters of soil model type, effective unit weight, cohesion or friction angle for each soil stratum encountered, and the water level in each boring. We do not expect rock to be encountered during the field activities. We understand that it the ENGINEER currently anticipates that lightly loaded structures and/or equipment pads may potentially be supported on shallow foundations. We will design parameters for shallow foundations that include net allowable bearing pressure and resistance to sliding at the anticipated bearing depths including recommendations of passive pressure and sliding resistance. We will address the possibility of overstressing the shallow foundations under short sustained seismic or wind live loads. We will provide recommendations for resistance to uplift. We will provide recommended design groundwater level for determination of buoyancy — especially for proposed vaults - and means to resist buoyant forces. We will provide total and differential settlement estimates for the allowable bearing pressure. We understand that if loose random fills, soft subgrade soils and/or expansive clay soils are encountered, requirements for overexcavation and replacement of these materials shall be provided in the Report. We will address minimum and maximum historical frost depth. We will provide information for structures requiring over excavation and replacement of subgrade materials and include distances or extent of limits and depths to which over excavation and structural backfill will extend. 7. Lateral Earth Pressures We will provide lateral earth pressures for below grade vertical walls for the vault structures. We understand that the ENGINEER prefers that the lateral earth pressures be provided as equivalent fluid pressure values, however, equations may be developed for the same. We understand any assumptions relating to the construction method or type of backfill shall be outlined in detail (i.e. granular, cohesive, drained or undrained conditions). Slope Stability and Excavations We will address the recommended inclination of both temporary excavation and permanent slopes. We will identify OSHA soil types and address any temporary slopes required for excavation and the need for sheeting and shoring. 9. Excavation Requirements We will address the excavatibility of the soils and rock that may be exposed during foundation excavation and site grading. We understand that the effort and type of equipment utilized to perform excavations is dependent upon the size and depth of the excavation; and therefore our Report will include a discussion about the structures described, as well as utility trenches. 10. Dewatering We will report conditions present at the site requiring groundwater control, dewatering, or surface drainage during excavation and construction. We will provide a basis for various types of dewatering along with an approximated extent or time of operation, if applicable. We will give special consideration to exposed subsoils within the bottom of excavations during construction. 11. Corrosion Potential and Chemical Attack to Concrete We will present an evaluation of laboratory test results on representative subsurface materials for chemical constituents, specifically pH, chloride ion, soluble sulfates, and electrical resistivity as well as redox potential and j sulfides. These parameters will be evaluated for their potential for underground piping, for design of grounding, and for selection of cement type { to resist potential sulfate attack. Midwest GeoSciences will provide recommendation of cement type for concrete in contact with soil to resist chemical attack. Reese created the computer program LPILE during this tenure at University of Texas at Austin. Dr. Reese was recognized for his work and especially for creating geotechnical models through his software outlet: Ensoft, Inc.
