Additional Terms and Conditions
1. Section 4.6 of the Agreement is amended by replacing "a Late Payment Fee" with " 1 % per month late payment fee".
2. Section 4.3 of the Agreement is amended by inserting at the end of the paragraph the following: "To the extent that Nearmap is in breach of this
Agreement and does not remedy its breach in accordance with section 6.2 of the Agreement, this section will not apply and Nearmap will refund
the Licensee any pre -paid fees relating to the portion of the Term remaining as at the date of the breach."
3. Section 4.8 of the Agreement is deleted in its entirety and replaced with the following: "Intentionally Omitted."
4. Section 6.6 of the Agreement is amended by inserting the word "reasonable' before the words "costs incurred by".
5. Section 17.12 of the Agreement is amended by replacing "State of Utah" with "State of Indiana".
