PURPOSE The purpose of this Memorandum of Understanding is to define the agreement between Hamilton County Emergency Management and the Carmel Fire Department as it relates to the use, maintenance, deployment,and storage of the portable light tower Unit 2, model#GENRL4, serial#RL412-3873. This agreement will clarify the collaborative roles and responsibilities of the two agencies with the respect of the aforementioned light tower unit. II. AUTHORITY OR LEGAL STATUS WHEREAS The Indiana General Assembly, in Indiana Code 10-14-3-7(b)(5), authorized and provide cooperation between departments of government in disaster prevention, preparedness, response, and recovery. WHEREAS The Indiana General Assembly, in Indiana Code 10-14-3-16(a),authorized and provided for the director of a local organization for emergency management may develop or cause to be developed mutual aid agreements with other public and private agencies within Indiana for reciprocal emergency management aid and assistance in case of disaster too great to be dealt with unassisted. WHEREAS The Indiana General Assembly, in Indiana Code 10-14-3-16(b)(2), authorized and provided for the director of each local organization for emergency management shall carry out arrangements or agreements relating to the local and political subdivision. WHEREAS The Indiana General Assembly, in Indiana Code 36-1-7-3, set out the required contents for agreements entered into by any political subdivision of this State. III. ROLES AND RESPONSIBILITIES Hamilton County Emergency Management, using grant funding from the United States Department of Homeland Security, purchased the above mentioned portable light tower to aid in the response and recovery efforts during and after a disaster. However; in an effort to keep equipment exercised and maintained during non-disaster times, Hamilton County Emergency Management offered the Carmel Fire Department the opportunity to house and maintain the tower to be use at their discretion with the understanding that any preventative maintenance will be performed by Carmel Fire Department,or its designee, and any damage occurring to the Page 1 of 3 Hamilton County Emergency Management 0 * 18100 Cumberland Road, Noblesville, Indiana 46060 i t ; (317)770-3381 • https://hamiltoncounty.in.gov/em unit while in the possession and use of by the Carmel Fire Department will be solely the responsibility of the Carmel Fire Department and incur all costs associated with said repairs or maintenance. Maintenance shall include: 1. Housing the unit is a climate-controlled area out of the weather 2. Belts and lights should be checked weekly to make sure belts are tight and not worn or broken 3. Light bulbs working 4. Wires and connectors are in good condition 5. Generator should be started weekly and ran for at least 15 minutes 6. Oil shall be changed every two years or 250 hours (whichever comes first) 7. Fuel filter should be changed every five years or as needed. 8. Do not leave tower parked in one spot for an extended period of time to prevent flat spots on tires 9. Extend tower monthly and lubricate as needed 10. Reporting all maintenance activities to Hamilton County Emergency Management Prior to purchasing any parts, please check with HCEM to determine if they have parts available. Parts can be ordered from McCallisters in Fishers. Hamilton County Emergency Management agrees that responsibility of damage occurring to the unit while not in the direct possession or use of by the Carmel Fire Department falls on the Hamilton County Emergency Management and will incur all costs associated with the damage. The Carmel Fire Department also agrees,that at any time regardless of its current use, Hamilton County Emergency Management reserves the right to remove the light tower,with coordination from the Carmel Fire Department, and deploy elsewhere during times of an emergency or disaster. IV. GENERAL TERMS AND CONDITIONS Now therefore, Hamilton County Emergency Management and the Carmel Fire Department jointly agree to the following terms: a. Terms of this Agreement shall be for three years from the date of execution and renewed automatically for three-year terms thereafter. b. Either Party may terminate the Agreement by giving 30 days written notice to the other party any time after the initial term.The termination letter shall be served upon the Chief of the Carmel Fire Department in the case of Hamilton County Emergency Management terminating or service directly to the Executive Director of Emergency Management in the case of Carmel Fire terminating the agreement.
