The regular meeting of the Board of Trustees was called to order at 7:30 p.m.
by President William D. McFadden. Ail board members were present. Others
present were: Town Attorney, John Pearce amd Associate, N~ke Howard, Town
N~_.~a~er, Nell Schmeltekop, Fred Hohl, Jim Dou~erty, Fire Chief Swails. Clerk-
Treasurer Peggy Smith was absent, inasmuch as she was participating in the
semir~.~s at the IAO & T convention.
Trustee Swift moved to dispense with the reading of the minutes of the last regular
meeting end approve them as received, Trustee Rinshaw seconded it and the motion
passed un--~mously.
Cha~ 0rdert Brookshire Plent: Upon the recommendation of James Dougherty, Trustee
Rinshaw moved to approve change order #B2 increasing the contract of Eyrir Construction
Co. $1,97~.00, Trustee Stevens seconded and the motion passed unanimously.
Fire Ib3Ack: Chief Swails presented a letter from the Howe Fire Apparatus Co. stating
they had a possible buyer for the '58 fire truck for $9,000.00 if traded at this time.
Howe has offered to take this truck in trade for $8,000.00 when the new truck is delivered.
Trustee McFadden moved Howe could have the truck for $9,000 00 as soon as they needed it,
Stevens seconded it and the motion passed with 4 aye votes end one na~ vote (Rinshaw).
The new truck should be delivered by Nay 1976.
Bond Releaser Bon Bar Oorp: Upon the recommendation of the Town Engineer, ~ustee
Swift moved to release the bonds for grading end seeding, Principal Bon Bar Corp,
Trustee Hinshaw seconded the motion and it passed unanimously.
Vandalism: Town Manager, Schmeltekop, stated that the new sidewalks are being m~wked
before the concrete is dry. The police have been alerted end it ha~ asked the news
media to call this to the attention of the residents. The Town Engineer stated that the
newly placed street signs have been mutilated before they have been in place a week.
Tire slashing in the Woodlend Springs area has also been reported. A white Volkswagen
was seen in the area several times at the time of the tire slashing and the residents
have been requested to be on the alert.
Joint Step one Project: Carl Fox of the State Board of Health has scheduled a joint
meeting on September 30, 1975 at 7:30 p.m. at the Fidelity Bank on ~6th Street &
Meridien to discuss the progress of the sewers. The Town Board members and their
consulting engineers of Carmel, Fishers end Westfield have been invited, i~-ustee
McFadden requested that all the Town Board Members be present. Fishers Town officials
have indicated they shall be in attendance.
Ralnh Wilfong: Attorney Willis Kurtz spoke for Wilfong stating the reason for the extra
charge of approximately $28,000.00 was due to the State Board of Health request for the
cleaning of the old sewer plent before the new plent could be put into use. The origi~.l
contract was for $250,000.00 end was for the engineering end construction of a complete
package plent which would then be leased to the Town of Carmel. Re stated the State
Board of Health requested the improvement to the old plent end that approval was directed
to the Town Boardnot to Ramilton Westeru. Trustee Hinshaw asked if the old plant was
working to capacity before. K~m~ stated the plent after repair is now working at double
the capacity as before. Trustee McFadden asked who is going to pay the additional
$28,000.00 that H-m~lton Western's contractor was told to spend Carmel's money with out
the Trustee knowledge? They should not have exceeded the contract price of $250,000.00
without additional plans and specifications. $~,000.00 was spent for a silencer which
was not in the contract, and hydroseals used in the correction of the Carmel plant are

some of the additional expenditures. Hinsh~w asked Zinsmeister, Hohl, Dou~erty,
each if they had authorized any additional expenditure. Each stated they hadnot.
He then asked Wilfong if he had authorized the additional amount. He stated that
he had not. Kunz felt the additional amount was spent on the improvement to the
old plant. Trustee Hinshaw moved the Town not authorize any further expenditures
for the improvements to the North Sewer auxilary plant. Motion died for the lack
of a second. Stevens suggested splitting the $28,000.00 as the hydroseals had not
been included in the original contract and it has now increased the old plant capac-
ity lO0,O00 gallons. Trustee Swift asked Zinsmeister if he had knowledge of %he im-
provement costs. Zinsmeister stated he had contacted ~m~lton ~sternand there had
been much correspondence. McFadden requested Kunz to notify the Town Attorney what
hi~ client expects of Carmel. Zinsmeister is to supply a final break down of the
engineering co'ts and'final construction costs and have these figures in~amilton
Westerns h~.~ds by September 28th, so that copies can be made and given out to Carmel
Town Board members at the Joint Sewer meeting on the 30th. Discussion will be
resumed at the next meeting of the Town Board on October 14th, and a decision will
be reached at that time.
Water Main Sizing, Joe Dawson: The Comprehensive water plan was discussed. It was
felt we should not ch~.n~me the present plan at this time. Dawson was requested to
put in 20" pipe. He stated he would have to put in approximately 1,800 feet of
20" pipe and he would like to get it in this fall.
Woodland Street Li~ts: The Woodlaz~d Homeowners Association has requested an
extension of time to raise the money for 31 additional street lights. The home
owners have indicated they will each contribute up to $90.00 for the street lights.
The deadline has been extended to October 31. ~ustee Stevens moved the to~n allocate
money for the 3~ additional lights, Trustee Swift seconded and the motion passed
unanimously.
R D Mart Realt[: Bob Mart requested to be placed on the agenda for the regular
meeting of October ~tth so that the sewers for a portion of land south of Fishers
can be discussed at that time.
Illumination Lighting, Carmel Dr. and Keystone: The state has refused to put up
lighting at that intersection. It was stated it would cost $12,000.00 for these
lights and Carmel will have to assume this cost.
Stop LightsI Carmel Dr. and R~.~eline Rd.: Bids for these lights have been advertised
to be let October 12th, and should be in place sometime during December 1975.
Town Engineer stated the State has let bids for asphalting of the west p~rtion of
s~ 232.
Trustee McFadden instructed a letter to the Board of Directors of the Farm ~ureau
be sent requesting an option for a period of one yea~ for the placement of the
water storage plant on their property. Trustee Swift and Hinshaw were requested
to work with Town M~ger for alternative water tank storage location.
Trustee Hinshaw requested the relocation of speed wa~ signs. The Town
Engineer was instructed to place reduced speed signs in addition to the use of
radar warning at the City limits.
The ~ustafson property at the northeast corner of First Street NWie available for
$30,000. The property consists of a lot and one house. It was suggested the
Board look into the possibility of purchase for future City expansion.
Bond Release, Brookshire North: Upon the recommendation Of the Town Engineer,
Trustee Beach moved to release the bonds on street, curbs and gutters, sanitary

storm sewers and water mains and hydrants in Brookehire North Section 1, Principal
Lumber Mart, Inc. Trustee Hinshaw seconded and the motion passed ,,r~mously.
There being no further business, the meeting was adjourned at 9:25 p.m.
