Board was called to order at 7.40 by President Wilkinson,
with all members present excepting Johnson].
The minutes of the previous meeting were read and approved.
R.W.Castor presented a bill for ~7.50 for digging 1/~ of
20 rod of ditch on West Water Street. Idoved by Hawkins and
seconded by Daubenspeck to allow this~bill. Motion carried.
Columbus Dugan presented a bill for 7.50 for digging 1/2 of
20 rod of ditch on West Water Street.Motion made by Hall
and seconded by Hawkins to allow this bill.Motion carried.
A motin was made by Daubenspeok and seconded by Hawkins for
John T.Booth to act as Street Commissioner. Mo in carried.
Curfew
ordinance was read.A discussion of same took place.

The Board was called to order at 7.45 by the President,
C.E.Wilkinson,with all the members present. ~linutes of the
last meeting read and approved. A bill of ~6.00 for' printing
ordinance regulating closing hours of Pool rooms was
presented by the Carmel Standard.The bill was allowed.
Pay roll for ~37.95 for week ending ~arch ~6,was presented
by ~arshal Booth and allowed. Pay roll for ~107.83 for
week ending Apr. 2,1910 was presented by ~,larshal Booth and
allowed. Bill for $3.00 was presented by Lee Brunson for
cleaning snow off of sidewalks and was allowed.
The question as to wether the Treasl~rer should ~ay labor
before meeting of Board was discussed. J.T.Booth,Street
Commissioner,agreed to pay for a time at least labor bills
as they came up and present his bill at the end of the
month. The Curfew ordinance was brought up for second
re d~ng.~otion By Hawkins and seconded by Hall not to adopt
the ordinance carried as follows:

An ordinance was read to regulate the kinds of Build~ngs
to be erected or remodeled within the fire limits of the
town. This ordinance was discussed by the Board. It was moved
by Johnson and seconded by ~awkins to adopt aforesaid

A site for a dumping ground was discussed and F.W.Johnson
was ordered to see Henry Richardson and secure site if
possible.Board then adjourned to meet Apr.ll.1910.

Board was called to order at 8.00 by Trustee B.D.Hall,
with all member-s present except Wilkinson.
~gr.of Light and Water Ce.of Zionsville gave a short talk
on the condition of lighting of ~r~ town. Health Officer,
R.A.Cooper presented a paper whish he desired printed as
a warning to clean up.Moved and seconded to allow 200 of
same to be printed and distributed.Motion was unanimously
carried. A discussion for the gr&de line for North k%in Street
and South i,iain Street then took place. It was moved a~d
seconded to appoint James Shannon,town engineer. Motion
was unanimously ~ ~'
sarr~. An ordinance regulating the
Railroad Company,a corporation within the corporate limits
of the town of Carmel.Hamilton County,Ind.was read and laid
over until next meeting for second reading and f~nal adoption
or rsjeotion. The resignation of ttarland Brown,deputy marshal
was read and accepted.And his bondsmen were thereby released.
Attorney ttershman gav~ his opinion as to the improvement
of Main Street,as follows;-
To the Honorable Board of Trustees of the Town of Carmel.
G E~TLE?.~EN: -
In Response to your request I herewith giv~
opin~on in regard to Main Street improvemeht in said town.
You have a perfect right to proceed to build new
walks as if no walks had ever been built,even though th~
original Barrett Law payments have not b~en fully paid,
except you san~ot go over the limit for which property
may be assessed.
You have a right to use your discretion in
matter and that in the absence of abus~ of such discretion
you may proceed as above indicated.
It is settled in my mind that you would have
th~ power to put in steps if you so d~sire, subject to
any cases for damages that might be brought, but it
would probably provoke the same contest as if you rebuilt
the walk and not be of the same public utility.
Th~ grade for curb should be established by a
civil engineer, making a record on his book for the same
and the.n be formally adopted by the Town Board of Trustees
and placed of record on the minute~ of sai~ Board.
You hav~ the right,to pay all,part or none of
the cost of a street improvement from the general fnn~s,
and if you so d~cide to assess the property benefitted
to pay the cost thereof, you must assess the property
aosording to S~atute.
In grading a street,shade trees may be removed
and if destroyed the lot ow~er is ~.ot entitled to damages,
unless they were killed through negligence or carelessness.
Shade trees when in the side walk may be removed by the town.
Shade trees upon the edge of street are not obstructions.
A shade tree in the street,and not on the margin of the
sidewalk, is an obstruction and may be removed.
The law says in order that. the town may cause a
railroad to place Electric Gongs or bel~s at th~ intersectioms
of its streets wit]~ the said railroad it must enact an ordinance
and place a copy of the same in the hands of the nearest
railroad official which in this ~nstance would be the
operator at the If. orion Railroad.

The~was a disoussion of lowerimg sidewalk on
North and South Main Street.
The Marshal was instructed ~o put up posts and boards to keep
people from drivimg off embankments.
The Board adjourned to meet next Monday night
for a oontifluation of business.
