BOT 1920 (07-05)EeOD o,,, 0armel,. Ind., July 5, 1920. The Board met at the library at 8 O'clock with the following members of the Board present: James M. Nutt, John Lee, Isaac Bales and E. E. Small. The matter of a resolution to the State Highway Commission was diseu cussed with the result that the following resolution was adopted, and the Claerk was ordered to forward a copy to the Oommission; A Resolution by the Board of Trustees, of the Town of Carmel, in Hamilton county, State of Indiana, authorizing and requesting the State Highway Commission of Indiana, to improve and construsct the pub lic highway, through the town of Carmel, known as the Range Line road, from the south limits of said town to the north limits thereof and agreeing to reimburse said commission for any additional cost per mile for like work outside of said town. Whereas~ The State Highway Comission of the State o'f Indiana, has ordered the irmprovement and construction of a public highway, on the Range Line road, connecting with the southern limits and extending on Main street in and through the town of Carmel, to the northern limits thereof, and Whereas, By act of the General Assembly of the State of Indiana, Appreved March 10, 1919, said commission at its discretion is empow- ered to order the construction of highways through incorporated townm of said State, Therefore, Be it Resolved, By the Board of Trustees of the Town of Carmel, In the county of Hamilton and State of Indiana, ~hat said town hereby consents to the construction of said road, on Main street, in said town and requests said coranission to construct the same from the south limits to the north limits of said town, in the way and in the manner deemed by. said commission to be just, right and advisable, and said town hereby agrees to reimburse said commission for any additional cost per mile, over and above the average expense, for like work outside of the corporate limits of said town ~is provided in section BY, page l$1, Acts of the General Assembly, aforesaid. The vote adopting the above resolution was as follows: Yeas Nays Small ~ 0 Lee Bales At this time the tree ordinance discussed at the July 2, meeting of the board, came up for disposition. The following ordinance was adopted relative thereto, by the ~ote as follows: Yeas Nays Bales 0 8~nall Lee TItEE ORDINANCE: An ordinance requiring the cutting and removing limbs and branches from the lower part of the body of shade trees, on or along the streets and alleys of the Town of Carmel, Indiana, where the same interferes with the shining of the sun on said streets, pro- hibiting the owners of real estate from permitting the growth of certain limbs and branches on trees, providing a penalty, and deoaaring an emergency. Section 1. Be it ordained that all owners of real-estate in the town of Carmel county of Hamilton, State of Indiana, having any shade tree or trees planted, growing or standing on or along the line of any street or side walk of said town, where the shade of such tree or trees interferes with or prevents the rays of the sun from reaching such street or shining thereon, shall be required to sever and remove from the body of such tree or trees the branches or limbs thereof, or cause the same to be done so as to permit the rays of the sun to reach any such street and to shine thereon, which cutting and removing of said limbs and branches shall be done within a period of ~Etaa~days from the taking effect of this ordinance, under the supervision of the marshal of said town, with the approval of the Board of Trustees aforesaid. Sec. 2. It shall be unlawful for any owner of real estate aforesaid to fail to comply with the provisions of section one of this Ordinanceor any part thereof, or to hereafter permit the growing of branches and limbs on the body of any such shade tree or trees, where the same prevents and interferes with the rays of the sun reaching or shining upon any street in maid town. Sec. 3. Any owner of real estate in said town, violating any of the provisions of this ordinance or failing to comply with the same, may be fined in any su~., not exceeding ten dollars. An emergency existing for the imediate takin~ effect of this ordi- nance, the same shall be in force and effect from and after its --- passage. Them eeting was continued over.
