WAIVER, RELEASE AND GRANT OF PUBLICATIONS RIGHTS
The City of Carmel, Indiana, by and through its Board of Public Works and Safety ("City"), in
consideration of the payment of $1.00 and other good and valuable consideration, hereby grants to Martin
Marietta Materials, Inc., its' officers, agents, employees and subsidiary corporations ("Martin Marietta"),
the right to use and publish quotations, statements, whether oral or written, and images approved by the
Mayor of the City of Cannel or his designee and thereat~er given by the City to Martin Marietta in
connection with the publication of material for the promotion of the Concert in the Quarry only.
The City hereby releases any and all rights it has in the quotations, statements or images and agrees to hold
Martin Marietta Materials harmless from the publication and use of such materials for the express purpose
set forth herein above, whether such publication is printed, on film, or in any other medium.
