Prevail/DOLMEMORANDUM OF UNDERSTANDING AGREEMENT
This Memorandum of Understanding is entered into by and between the City of Carmel and its
Police and Communications Departments, by and through the City's Board of Public Works and Safety
("City"), and Prevail, Inc., a corporation duly licensed to conduct business in the State of Indiana and with
offices located at 1100 South 9th Street, Suite 100, Noblesville, Indiana 46060 ("Prevail").
WHEREAS, Prevail, in association with ADT Security Systems, Inc., participates in the
nationwide Abused Women's Active Response Emergency ("AWARE") program designed to provide
battered women with no-cost home secudty systems and 24-hour monitoring; and
WHEREAS, the City desires to assist Prevail in its lawful operation of the AWARE program within
the City.
NOW, THEREFORE, in consideration of the foregoing recitals, the parties mutually agree as
follows:
1. The foregoing Recitals are fully incorporated herein by this reference.
2. Prevail will release confidential information regarding AWARE program participants who
have an ADT Alarm installed in their home for reasons of domestic violence, as well as pertinent
perpetrator/abuser information.
3. The City agrees that the information so lawfully provided to it by Prevail pursuant to
this Agreement will be kept confidential and used for purposes in furtherance of the AWARE program.
IN WITNESS WHEREOF, the parties have signed this Agreement on the date below their
respective signature or the signature of their representative. The effective date of this Agreement shall be
the date on which it is last signed by a party hereto.
