EXECUTIVE ORDER

WHEREAS, Indiana Code 36-1-12 establishes certain procedures to be followed when
awarding and changing public works contracts; and,
WHEREAS, the City of Carmel awards public works contracts through its Board of Public
Works and Safety ("Board"); and,
WltEREAS, it is often necessary to change the original contract specifications of a public
works project through the issuance of "change orders"; and,
WHEREAS, it is prudent and right for the City Attorney to review and approve all "change
orders" to public works contracts to ensure that they comply with applicable Indiana law.
NOW, THEREFORE, by the power and authority granted to me as Mayor of the City of
Cannel, Indiana, I, James Brainard, do hereby declare and order that, effective on and after March 19,
2003:
(1) All "change orders" to public works contracts shall be reviewed and
approved by the City Attorney or, in his absence, the Director of
Administration, prior to being placed before the Board for action. This
includes, but is not limited to, all "change orders" for public works projects in
which the Board has given a Department Director authority to make changes
that do not individually exceed five percent (5%) of the original project cost
or, when combined with other project changes, ten percent (10%) of the
original project cost; and,
(2) All approved "change orders" shall contain on the face thereof an
approval stamp initialed by the City Attorney or, in his absence, the Director
of Administration./
