E)~ECUTIVE ORDER
JB-09
WHEREAS, on March 18, 2002, the Common Council of the City of Cannel, Indiana, at the
request of the City Attorney, approved an additional appropriation from the General Fund of Two
Hundred Seventy Four Thousand Dollars ($274,000.00); and
WHEREAS, the purpose of this additional appropriation was to fund the settlement of a certain
lawsuit captioned Leeper Electric Services, Inc. v. City of Carmel, et al., Cause No. 30C01-9703-CP-76,
currently pending in the Hancock Circuit Court (the "Lawsuit"); and
WHEREAS, it is now prudent to return to the General Fund these funds not reasonably necessary
for the City's operation during the remainder of the 2002 fiscal year, nor needed to be encumbered into
2003 fiscal year for the purpose for which they were appropriated.
NOW, THEREFORE, I, James Brainard, the duly elected Mayor of the City of Cannel, Indiana,
pursuant to Indiana Code Section 36-4-7-8, which authorizes me to decrease budget appropriations made
for any Executive Department by the passage of an additional appropriation ordinance, do hereby order
and direct that the Two Hundred Seventy Four Thousand Dollars ($274,000.00) currently appropriated
and accounted for in the 2002 Department of Law Budget, Line Item Number 430-58400 - Refunds,
Awards and Indemnities, be decreased in its entirety, leaving a balance of Zero Dollars ($0) in said budget
line item.
