1984
THIS AGREEMENT entered into by and between the City of
Carmel, Hamilton County, Indiana, hereinafter called "City" and
Clay Township, Hamilton County, Indiana,
"Township" as of the 1st day of January,
WITNESSETH:
WHERAS, the City (formerly Town) and Township on

the 2nd day
of May, 1961, entered into an agreement by the terms of which
the Township was joined to the Town of Carmel for the purpose
of zoning, and
~EREAS, in a preliminary discussion the City and Township
made an estimate of anticipated expenses and income to be
derived from the operation of the zoning law of the City for the
year 1984, and
WHEREAS, the Township included within its budget for the year
1984 the sum of Fifty-Seven Thousand Seven Hundred Sixty-Three
Dollars ($57,763.00) which represented forty percent (40%) of
the preliminary estimate made for the cost of operating the
zoning law in 1984, and
NOW, THEREFORE, it is mutually agreed by and between the City
and Township that:
1. The Township agrees to pay the sum of Twenty-Nine
Thousand Dollars ($29,O00.O0) unto the City on or before July 14,

1984, and the additional sum of Twenty-Eight Thousand Seven
Hundred Sixty-Three Dollars ($28,763.00) to the City on or before
December 31, 1984.
2. The City agrees to accept and use said funds to
supplement other funds available for the operation of the Plan
Commission, the Board of Zoning Appeals, and the Department of
Community Development.
3. The City agrees to furnish a complete statement as to the
income and expenditures for zoning quarterly, by calendar
quarters, k
4. At the end of the.year 1984,
expenditures made in the year 1984
the total of all
for zoning expenses shall be
computed and from that amount all income received by the City
in connection with the operation of the zoning laws of the City
shall be deducted and the net cost to the taxpayers shall
thereby be computed. If the amount of the cost ofjthe taxpayers
for the year 1984 is less than One Hundred Forty-Four Thousand
Four Hundred Eight Dollars ($144,408.00), then and in that
event, the money budgeted and unspent shall be applied against
the budget for 1985, and the pro-rata share of the Township of
the budget for 1985 shall be reduced accordingly.
5. This agreement shall be in full force and effect as of
the 1st day of January, 1984, and 'continue until the 31st day
'of December, 1984, unless both parties agree in writing to any
change.
IN WITNESS WHEREOF, the parties have hereunto set their hands
and seals as of the 1st day of January, 1984.
