1983 Carmel/Clay TwpZONING AGREEMENT
THIS AGREEMENT, made and entered into by and between the City of
Carmel, Indiana, hereinafter ·referred to as "City", and Clay Township
of Hamilton County, Indiana, hereinafter referred to as "Township",
WITNESSETH:
WHEREAS, the City (formerly Town) and To~rmship on the 2nd day of
May, 1961,'.enter'ed into an agreement by the terms of which the Town-
ship was joined to the Town of Carmel for the purpose of zoning, and
WHEREAS, in a preliminary discussion the City ann Township made
an estimate of anticipated expenses and income to be derived from the
operation of the zoning law of the City of Carmel for the year 1983,
and
WHEREAS, the Township included within .its 'budget for the year
1983, the sum of Forty-Eight Thousand One Hundred Eighty-Six Dollars
($48,186.00) which represented forty percent (40%) of the preliminary
estimate made for the total cost of operating the zoning law in 1983,
~and
WHEREAS, the total budget amount for ~oning for the year 1983
was subsequently reduced to One Hundred Twenty Thousand Five Hundred
Thirty-Six Dollars ($120,536.00) of which amount the Township is
responsible for forty percent (40%), or Forty-Eight Thousand One
Hundred Eighty-Six Dollars ($48,186.00).
NOW, THEREFORE, it is mutually ageed by and between the City and
Township that:
1. The Township agrees to pay the sum of Twenty-Four Thousand
One Hundred Eighty-Six Dollars ($2~,186.00) unto the City on or
before July 15, 1983, and the additional sum of Twenty-Four Thousand
Dollars ($24,000.00) on or before December 31, 1983.
2. The City agrees to accept and use said funds to supp%ement
other funds aVailable for the operation of the Plan Commission, the
Board of Zoning Appeals, and the Department of Community Develop~
ment.
3. The City agrees to furnish a complete statement as to the~
income an~ expenditures for zoning.quarterly by calendar quarters.
4. At the end of the year 1983, the total of all exped~tures
made in the year 1983 for zoning expense shall be~computed and from
that amount all income received by the City in connection with the
operation of the zoning laws of the City shall be deducted and the
net cost to the taxpayers shall thereby, be computed. If the amount
of the cost of the taxpayers for the year 1983 is less than One Hun-
dred Twenty Thousand Five Hundred Thirty-Six Dollars ($120,536.00),
then and in that event, the money budgeted and unspent shall be
applied against the budget for 1984, and the pro-rata share of the
Township of the budget for 1984 shall be reduced accordingly.
IN WITNESS WHEREOF, the City and the~ Township by and through
their duly elected, qualified and acting officials have hereunto
caused their names and seals to be affixed as of the 1st day of
January, 1983.
