Z-387-02 PUD-West ClaySponsor: Councilor Snyder ORDINANCE NO. Z-387-02 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA AMENDING THE WESTCLAY VILLAGE PLANNED UNIT DEVELOPMENT DISTRICT WHEREAS, Section 31.6.4 of the Carmel/Clay Zoning Ordinance Z-289, as amended (the "Zoning Ordinance"), provides for the establishment of a PUD District in accordance with the requirements of IC 36-7-4-1500 et. seq.; and WHEREAS, Ordinance No. Z-330 establishes the WestClay Village Planned Unit Development District (the "District") on the real estate more specifically described in Exhibit "A"; and WHEREAS, the Carmel/Clay Plan Commission has recommended that Ordinance No. Z- 330 be amended and restated as provided in Exhibit "B" herein; and WHEREAS, the Common Council of the City of Carmel, Indiana, has given reasonable regard to the Comprehensive Plan and the other matters specified in Section 31.6.4(4) of the Zoning Ordinance when considering said amendment to Ordinance No. Z-330; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana, as follows: Section I: Pursuant to IC 36-7-4-1500 et. seq., Ordinance No. Z-330 is amended and restated and as thus amended and restated constitutes an amendment to the Zoning Ordinance. Section II: This Ordinance shall be in full force and effect from and after its passage and signing by the Mayor. The area affected is generally located on the southeast and southwest comer of West 131st Street and Towne Road, Hamilton County, Indiana. The Carmel/Clay Plan Commission's recommendation on the petition of Brenwick TND Communities, LLC, is FAVORABLE.
