RATLIFF, EXECUTIVE DIRECTOR PARTNERSHIP AGREEMENT SEPTEMBER 12, 1996 Background: Recently all 15 local elected officials of the seven county area approved a revision to the Private Industry Council/Local Elected Official Partnership agreement concerning liability for disallowed costs. The agreement does not specifically indicate how responsibility for any such costs would be divided among the counties and cities. The Hamilton County Commissioners requested that a method for doing so be added to the agreement. I have prepared the following proposed addendum to the agreement which provides a method for sharing cost responsibility based on the benefits received by each county, specifically based on the number of county residents served. Addendum to PIC/LEO Partnership Agreement County and municipal entities will be equally responsible for costs originating in their county. Joint costs will be allocated to each county based on the number of beneficiaries in the county compared to the total number of beneficiaries in all seven counties. Beneficiaries are persons participating in JTPA funded activities during the program year. Signature' ~ Date alternative language please let me know. DWD is also asking that all local elected officials sign the agreement. This is a change from prior years when only the Chair's signature was required. The PIC/LEO agreement designates who will administer and operate programs, procedures for developing the job training plan of service, oversight responsibilities for Council Members and Elected Officials, and liability for disallowed costs. With respect to disallowed costs, the agreement states that Inte~ocal Association assumes this liability. Interlocal Association has operated JTPA funded programs in the seven county area for over 13 years starting on October 1, 1982 and the local elected officials have not had to repay any disallowed costs. In order to receive funding for the year beginning July 1, 1996 an acceptable PIC/LEO agreement must be in place. I believe the current agreement which was approved on March 21, 1996 would be acceptable if the word "may" is changed to "will" in the last sentence of Section 6. Liability for Disallowed Costs and the signature of each of the 15 elected officials is obtained. A copy of the current agreement and of the proposed revision to Section 6 and revised signature page are enclosed for your reference. The balance of the agreement as approved in March is unchanged. I will be contacting you in the next few days to discuss this change and to determine how to obtain the necessary signatures. Executive Director Enc(2) PIC/LEO Partnership Agreement Page 4 Liability for Disallowed Costs The Interlocal Association has financial liability for disallowed costs under JTPA. The Interlocal Association will repay disallowed costs from organizational resources. The organizational resources of the Interlocal Association, which are not employment and training grant funds, consist of assessments levied on each member City by the Board of Directors, and earnings from consulting contracts with member cities. These resources are maintained in the Interlocal Association General Fund Account. In the event the amount of costs to be repaid exceeds the balance available in the fund, the Interlocal Association Board of Directors will determine the amount of any additional assessments or charges needed from member cities to fulfill repayment obligations. The State of Indiana will hold the local officials responsible for repayment of disallowed costs not paid by Interlocal Association.
