THE CITY OF CARMEL, INDIANA AND PHILLIP ;A. & PATRICIA A.DYER
This Agreement entered this 6th .day of March
between the City of Carmel, Indiana (hereinafter "Carmel")
Philtip A. and Patricia A. Dyer.

WINESSETH
WHEREAS, Carmel duly adopted and enacted ordinance S-41 (Jaquary
5, 1982) that provides in part for the reimbursement by Carmel of
private funds expended for sanitary sewer extensions as determlned by
the Board of Public Works and Safety, and
WHEREAS, Phillip A. and Patricia A. Dyer desires to extend an off
site sanitary sewer extension in Cedar Lake Subdivision, Carmel,
Indiana at an increased cost of' $60,064.00
'NOW THEREFORE, the parties agree as follows:
1. This written Agreement entered prior to the commencement of
constr~uctzon ~s execute~ by the parties pursuant to ordinance S-~I
(Section 7.02 and 7.04 of the Carmel City Code)(January 5, 1982).
2~ Phillip .~. and Patricia A. Dyer shall install and pay for the
sanitary sewed'extension to.qedar Lake Subdivision and advance the sum
of $ 60,064.00 to or on behalf of Carmel to pay for the construction
of the sanitary sewer extension.
3. Carmel determines such expenditure ~o be necessary to provide
adequate sewage hollection to adjacent real estate and to meet the
requirements of Carmel.
4. Carmel and Phillip A. and Patricia A. Dyer agree that Phillip
A. and Patricia A. Dyer shall Re entitl~d to reimbursement of the sum
of $ 60~06~°00 from the "Interceptor Fund" established pursuant to
ordinance S-41.
5, Carmel's obligation shall be to repay funds from those deposited
in the "Interceptor Fund" and Carmel does not incur any liability for
repayment other than to pay from funds deposited in the "Interceptor
Fund".
IN WITNESS WHEREOF, the parties have executed this Agreement on the
date first above written.
