Wilson/McDonalds/Sign LocateSIGN LOCATION ACREE~ENT The City of Carmel (hereinafter "Carmel") and Wilson Office Plaza and McD-500, Inc. (hereinafter "~lcDonalds") agree to the re- location of a certain sign as follows: 1. Carmel agrees that Wilson Office Plaza and McDonal-ds shall be entitled to construct, erect and maintain an identification sign located at the southwest corner of property owned by McDonalds, com- monly known a~ th~ northeast corner of Carmel Drive and Keyston Way, the legal description of which, is attached hereto as Exhibit "A". 2. The sigfi contemplated by this agreement and its support structure shall not exceeed six (6) feet in height and shall not ex- ceed thirty-two (32) square feet per side in area. 3. The sign will be located so as to permit clear vision at the intersection of Carmel Drive and Keystone Way, the exact placement to be authorized by the Carmel City Engineer. 4. wilson Office Plaza agrees by this agreement to vacate its sign variance in the median strip of Keyston%Way, located immediately North of Carmel Drive, the provisions of this agreement being substi- tuted for Wilson Office Plaza's variance vacated by this agreement. 5. The structhre and configuration'of the sign shall be sub, stantially the same as that attached hereto as F~xhibit "B". Councilman Ted and Building Commissioner Jim Anderson, on behalf of the City, Johnso~ini~iatsd the project--then contacted McDonald', Wilson Office Plaza owner, Tom W~lson, and Fidelity .Bank. These three businesses are paying all expense to reconstruct the north side of Keystone Way and making it three-lane by eliminating the island. The island was the place for signage for the Wilson Offi'ce Plaza. McDonald is giving up a section of its property at the northeast corner of Carmel Drive and Keystone Way to make the righthand turn wider and safer. The City Engineer, City Attorney, and all above have been involved for over three years. In removing the island, McDonald's agreed to the'Wilson signage on the McDonald's property. The city appreciates the cooper, a~ive agreement between government and private enterprise. AnOther plus to this agreement is that Indiana 'State Highway Department told the City ~,.f the island was eliminated, it would assist this inter- section by posting "No T~rn on Red" signs on the northwest corner to ease t~e. continuous~flow into that intersection. If, at any time, a change in names or additional names are requested to be addedw then this agreement becomes null and void in its entirity. McDonald's must get the sign permit after agreement is sign- ed by the Board of Public Works and Safety. City engineer must suggest and~approve the location of said sign. No mounding will be~perraitted; the height of the si~n must be 6 feet from present ground level and 9 foot, 3 inches in width as sho~in the attached si~n diagram.
