10.3.22 CC Meeting Minutes1 COMMON COUNCIL MEETING MINUTES MONDAY, OCTOBER 3, 2022 – 6:00 P.M. COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEETING CALLED TO ORDER Council President Kevin D. Rider; Council Members: Laura Campbell (via Microsoft Teams), Sue Finkam, Adam Aasen, Anthony Green, Timothy Hannon, Miles Nelson, Jeff Worrell and Deputy Clerk Jacob Quinn were present. Councilor H. Bruce Kimball was not present. Council President Rider called the meeting to order at 6:00 p.m. AGENDA APPROVAL The agenda was amended to move Ordinance D-2639-22 ahead of Resolution CC-04-18-22-01 and approved unanimously as amended. INVOCATION Pastor Ben Snyder, Carmel Friends Church, delivered the Invocation Councilor Worrell led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES AND OUTSTANDING CITIZENS Councilor Worrell read aloud a proclamation recognizing October as National Disability Employment Awareness Month. Councilor Campbell announced information on a workshop on October 27th at the Braunability Offices that will discuss the benefits to hiring individuals with disabilities and share resources and information on accommodations that business may need when hiring those with disabilities. RECOGNITION OF PERSONS WHO WISH TO ADDRESS THE COUNCIL Jill Meisenheimer, Carmel Citizens for Responsible Zoning, addressed Council concerning Resolution CC-04-18-22-01 (The Comprehensive Plan). She stated that she supports the amendments made in the last Land Use and Special Studies Meeting, however the Plan as written will have harmul effects on Carmel’s established single-family detached residential areas, neighborhoods and for people that are going to move there. The plan is open-ended which is encouraging rapid population growth and the spread of more intense urban development within and next to Carmel’s existing low density single-family homes, suburban areas and neighborhoods. This plan promotes increased building heights, increased lot coverage and small lots and setbacks which means less green space and privacy. The plan mentions tree preservation but has no plan for meaningful enforcement. CONSENT AGENDA Councilor Finkam moved to approve the consent agenda. Councilor Nelson seconded. There was no Council discussion. Council President Rider called for the vote. COMMITTEE REPORTS Councilor Worrell reported that the Finance, Utilities and Rules Committee had met and reports would be given when the items appear on the agenda. Councilor Campbell reported that the Land Use and Special Studies had not met. OTHER REPORTS – (at the first meeting of the month specified below): Henry Mestetsky, Executive Director of the Carmel Redevelopment Commission, presented the monthly Redevelopment Commission report. Henry Mestetsky gave the bi-annual Redevelopment Authority Report. Winston Long gave the bi-annual Carmel Cable & Telecommunications Commission Report. , First Public Hearing Council President Rider announced First Reading of Ordinance D-2639-22; An Ordinance of the Common Council of the City of Carmel, Indiana, Establishing the Appropriations for the 2023 Budget. Councilor Worrell moved to introduce the item into business. Councilor Aasen seconded. Mayor Brianard presented the item to Council. He noted that after discussions with employee group representatives, they have made a slight change from a 5% cost of living adjustment and 3% one-time bonus to a 6% cost of living adjustment and a 2% one-time bonus. Council President Rider opened the public hearing at 6:30:30 p.m. Seeing no one who wished to address Council, Council President Rider closed the public hearing at 6:30:46 p.m. The item was held over until the next meeting and not sent to committee. Council President Rider removed the item from the Land Use and Special Studies Committee. Councilor Campbell reported that the Land Use and Special Studies Committee adopted 5 amendments. Councilor Campbell made a motion for Council to adopt those amendments and amend Resolution CC-04-18-22-01 as follows: On line 18, add objective 1.3.7: Protect single-family neighborhoods from dissimilar adjacent uses with respect to scale of buildings, building materials, lighting, noise and other incompatible impacts. On page 20, amend Objective 1.5.6 to read as follows – Encourage electrical and communication utility lines to be buried throughout the community to improve safety, especially in urbanizing areas. Care must be given to the location of underground and above-ground equipment so pedestrian infrastructure is not precluded by conflicts with these power facilities. On page 22, add Objective 1.6.17: Encourage the responsible use of energy through conservation of electricity in the night time lighting of non-residential buildings after normal hours of operation. On page 23, amend objective 1.7.6 to read as follows – Encourage mixed-use neighborhoods, where appropriate, to make it easier for people… On page 40, four amendments were made. 146th Street – removed typical corridor from Oak Ridge Rd to US 31. College Ave – Removed typical corridor from 116th to 108th. College Ave – Removed typical corridor from 104th to 96th. 96th street – remove typical corridor from Towne Rd to I-465. On page 57, three amendments were made. Removed proposed Local Rd segment between Rohrer Rd and Clay Terrace Blvd. Removed proposed arterial between College Ave and Westfield Blvd. Conservation Corridor designation added along River Road between Haverton Way and 116th St. Conservation Corridor. On page 69, added a multi-use path between Rohrer Rd and the Monon Greenway and added a multi-use path along Spring Mill Rd from 96th to 106th Streets. Lastly, there were 5 more proposed amendments concerning multi use paths. Add multi-use path along Haverstick between 96th and 99th, add multi-use path along Main from Richland to Keystone, add multi-use path along Guildford south of Old Meridian, add multi-use path along College Dr from Penn to 116th and add multi-use path along 99th from Westfield to Keystone. Councilor Green seconded. There was no Council discussion. Council President Rider called for the vote. The motion to amend passed 8-0. Councilor Finkam moved to amend page 34 by changing the Max. Height to read as follows: 2 greater than the adjacent development pattern with the following exceptions: maximum of 1 story along the river and maximum of 6 stories along 96th St. Councilor Hannon seconded. Council President Rider announced Resolution CC-08-01-22-01: A Resolution of the Common Council of the City of Carmel, Indiana, Approving Certain Matters in Connection with the Establishment of the Flora Economic Development Area. Councilor Worrell reported that the item is returning from the Finance, Utilities and Rules Committee with a positive 2-1 recommendation. Councilor Hannon stated he is generally supportive of TIFs, especially in the central core, but he is opposed to this because it is being done is a residential/non-mixed-use area. Councilor Aasen moved to approve Resolution CC-08-01-22- 01. Councilor Worrell seconded. There was no Council discussion. Council President Rider called for the vote. Resolution CC-08-01-22-01 was approved 6-2 (Green and Hannon Opposed). Councilor Worrell reported that the item is returning from the Finance, Utilities and Rules Committee with a positive 2-1 recommendation. There was an agreement in committee that the developer would send notification of future meetings to an expanded area of neighbors. Councilor Hannon stated that his objection to the ordinance is because this is a massive development which will not come back to Council (it will go through the Plan Commission) and given the scope there should be more engagement with constituents. Henry Mestetsky addressed Council and stated that he believes through their actions, PEDCOR has shown that they are here to engage with neighbors as much as possible. We know that prior to every planning meeting, there are going to be notices sent to all of those neighbors. Councilor Green stated that there is concern from the neighbors related to connections from the development into their neighborhood and the building height that is allowable in the project. Council President Rider announced the Second Reading of Ordinance D-2638-22; An Ordinance of the Common Council of the City of Carmel, Indiana, Authorizing the Issuance of Economic Development Tax Increment Revenue Bonds to Support the Monon Square North Project, and Authorizing and Approving Other Actions in Respect Thereto. Councilor Worrell reported that the item is returning from the Finance, Utilities and Rules Committee with a positive 2-1 recommendation. Councilor Hannon stated that he likes the project, but his concern is with the TIF deal being a 90/10 split. He would like to see more going toward local infrastructure. Heidi Amspaugh, Baker Tilly Municipal Advisors, presented to Council on how this bond relates to the tax rate and assessed values on properties in Carmel. Councilor Hannon moved to amend Ordinance D-2635-22 by adding to Exhibit A (13) grade-separated crossings along the Monon Trail at the intersections thereof with 96th Street, 106th Street, 111th Street and 136th Street. Councilor Green seconded. There was brief Council discussion. Council President Rider called for the vote. The motion to amend was approved 8-0. Council President Rider opened the public hearing at 7:54:30 p.m. Bill McGinnis addressed Council and asked that something be done about Veterans Way and Main St which he considers dangerous. Seeing no one else wished to address Council, Council President Rider closed the public hearing at 7:55:25 p.m. Councilor Finkam moved to approve Ordinance D-2635-22 As Amended.
