He further stated that forms of bond .ordinance and rate ordinance had been prepared by the attorneys for the Town for consideration by the Board relative to . the financing of the improvements, that said ordinances had been pre- pared upon the basis of data furnished by Clyde E. Williams & Asso. - 2 - ciates, Inc., consulting engineers employed by the T.own, and Carl O. Cecil, utility accountant empl9yed by the Town, and that it would now be in order for the Board to consider ancl. take action on said .ordinances. Trustee F . R; . Thereupon said ordinance was signed by all members of the B9ard and attested by the Clerk-Treasurer. The President of the Board then stated that it would now be in order for the Board to take up for consideration and act on an ordinance providing for an increase iti .rates and charges for water service fur- nished by the waterworks system. C. r~/C.X RAlJ> R R /('v1YJJ-M -9/IJ~ flI R K ..:n,_AJ S ~....; Nays: .!'tON E"" - 4 - ORDINANCE: NO; fl-9 An Ordinance establishing rates and charges for the use .of and services .rendered by the water- works system of the Town of Carmel WHEREAS, the Board of Trustees of the Town of Carmel has authorized the making of extensions and additions to the .existing water- works system..of said Town for. the purpose of providing. a sufficient supply .of water.ofproperty quality, at proper pressure, to the inhabit- ants of the Town and properly protecting the health, well-being and .property of said Town and its inhabitants; and WHEREAS, in order to..procure the necessary funds to pay the cost of construction and installation of said extensic;>ns and additions, it is necessary for the Town to issue and sell watel1works revenue bonds payable solely out.of the .revenues .of said waterworks system, which revenues under the existing schedule of rates and charges are insufficient to enable the :Town to finance the needed extensions and additions; and WHEREAS, the Board of Trustees now finds that the existing rates and charges for the use of and service rendered by the water- works of said Town are too low and are insufficient to enable the Town to properly operate its waterworks plant, provide for depreciation, and finance said extensions and additions; that the proposed exten- sions and additions will improve the service render.ed by said water- . . works system and make the same of greater value to the Town and its inhabitants, and that the existing rates and charges should be increased; now therefore, I )q/g) BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF CARMEL, INDIANA: Section 1. Private hydrant (each) $125.00 per annum 125.00 per annum Tapping Fees Each user, at the time he is connected with the water- works system, shall pay a flat charge of $50.00 to cover the cost of tapping the main, furnishing and lay- ing service pipe, corporation and stop cocks, service and meter box, and installing the meter. - 2 - Gollectionor Deferred Payment Charge All bills for water service not paid within fifteen (IS)' days from the due date thereof, as stated in such bills, shall be subject to a collection or de- ferred payment charge of lO%on the first $3.00 and 3"/0 on the excess over $3.00. Temporary Users Water furnished to temporary users, such as con- tractors, circuses, etc., shall be charged for on the basis of the above quantity rates as estimated by the waterworks superintendent. Railroads Water supplied for railroad use may be charged for on such terms as shall be fixed by specific contract approved by the Public Service Commis- sion.of Indiana. Sec. 2. All ordinances and parts of ordinances in conflict here- with are hereby. rep~aled; provided, however, that the existing schedule of water rates and charges shall remain in full force and .effect until the schedule of rates and charges fixed by this ordinance shall be approved by the Public Service Commission of Indiana, and until such time as the order of said Commission approving said new rates and charges shall direct. Sec. 3. On motion duly made, seconded and unanimously carried, the attorneys for the Town were directed to cause to be prepared, signed by the President and Clerk-Treasurer, and filed with the Public Service - 5 - Commission of Indiana, such petition as may be necessary to obtain the approval of said Commission for the issuance of the necessary water- works revenue bonds toJinance the construction.of the extensions, addi~ tJ.onsand improvements authorized to be made to the waterworks system of the 'Town, the letting of contracts for the construction of the same, and the approval.of the new schedule of water .rates and charges, all as provided for in the ordinances adopted at this meeting; also, to take such further acti6n as may be necessary to obtain a prompt hearing on said petition, to cause notice .of the hearing to be published as required by ~aw, and to prepare such data for use a,t such hearing as may bere- qui re d.
