INTERLOCAL AGREEMENT CONCERN
DRAINAGE*,STUDY'FOR WILLIAMS CREEK

WHEREAS, Williams; Creek flows through and provides a substantial surface water
drainage outlet"for certain portions of the City of Carmel (hereinafter referred to as."Carmel"),
and the; unincorporated areas of Hamilton County,, and,
WHEREAS, Williams Creek is not a regtlated drain pursuant to. the terms of Indiana
.Code 36-9=27; and,
WHEREAS,,the retention and controlled discharge of storm and surface-water is to the
benefit of all of the citizens°of,Hamilton County; and,
WHEREAS;, the Iarid;preseritly drained by W lliams,Creek (the Watershed) includes part
of Carmel. and unincorporated areas of the.County,which.have been and are anticipated to. be
developed, and,
WHEREAS; certain economies of scale and savings can be achieved by doing a
comprehensive study of the Williams Cieek,Di ainage-Shed; :and,
WHEREAS,:the=Hamilton County Drainage-Board, acting-through the Hamilton County
Surveyor, (hereinafter referred tons,"the County"), has agreed to prepare a, request for proposals
for a.private,company to do a,eorfpiehensiye study :of the Watershed; to receive and evaluate the
responses.to the request for proposals; anTto enter into a• contract, for, a study of"the Watershed
for the benefii:of the citizens of Carmel and the, County.
IT IS THEREBY AGREED by'and between the'parties hereto-as follows:-
1. 'The County agrees to prepare, and`,distribuie a:request.for proposals. for a,survey of the
Williams Creek Watershed. to define and determine ,a comprehensive drainage plan
for the Watershed, (hereihafter,referred'tb.as the "Watershed' Study").
2. Prior to. the award of & contract for the Watershed Study, the Surveyor shall provide
copies of the•proposals to each of the Drainage Board and the. City:of Carmel to make
comments and to review the recommendations of the Surveyor. The Surveyor shall
take into consideration such comments prior. to making a recommendation to the
Drainage Board.to award.the contract.
3, The County and Carmel_agreed,to:pay one-.half {112) of the cost of the Watershed
Study but no party shall:paymore than Fifty Thousand Dollars (S50000).
4. Each party hereto agrees to, pay their share, of the cost of the Watershed. Study within
sixty (60) days-of the notice by the County`of the successful bidder.
5. The Hamilton County Surveyor shall be deemed=to contact the-representative of the
parties to, administer`ihe contract for,the Watershe&Study.
6. The parties agree that they' will coffimunicate and cooperate `in providing all
information within their possession for the, contractor to perform Abe. Watershed.
Study.
7. This agreement shati be in full `force. and effect, binding on the,signatoe es hereto
upon the.exe&.ution of.this documcm.
8. The units that:are signatories,hereto may sign on;separatercounterparts and all parties
consent totcopies of counterpaft,signature -pages being attached to this Agreement.
ALL OF WNICH:IS AGREED -by,and between the parties. upon'approval by execution of
their signature..hereto, and,approvai-of a res6luti'6n substantially similar_`to,the attached.
