Hi, Nick: I am afraid that the Department cannot show your tabled itemas untabled. The official Nov. 20 plan commission
agenda was released to the public last Friday, and it shows that the legacy item as tabled to dec. 18. The public refers to
this agenda and makes plans accordingly; some citizens may not show up to the November meeting based on the
agenda, waiting until Dec. 18 to voice concerns about the Legacy item.
(I have copied the plan commission attorney on this email to see if he can offer a solution.)

Good afternoon! Platinum went before the Board of Commissioners today for approval of
access on 146th Street. They received approval for four (4) access points. At the west
end of the project, the large lot residential, they will have a right-in / right-out /
left-in. East of the residential they will have a right-in / right-out. Community Drive
will be a full access and east of Community they will have a right-in only. We will be
working with them on the design of each entrance and some additional agreements for
signalization and requests for access in the future.
As soon as the minutes to the Commissioners meeting are available, I will forward you a
cORY for your file. I will keep you informed as to the progress of plan approval. If you
have any questions, feel free to contact me.

Consider this response as confirmation that the previously proposed drainage easements located across the
rear yards of the lots along the eastern slope of Section One have been removed. Our intent is for the
surface runoff to sheet drain naturally through the existing treeline and on into the common area below. In
addition, and as the Preservation Plans indicate, we have added plant preservation easements (P.P.E.) along
the rear yards of those same lots (#62-#77). And finally, we have indicated on the plans that the existing
vegetation located at the end of the Brauer Lane stub street will remain in place until a physical connection is
required due to future development of the adjoining property.

confirm what you told me about the 20' drainage easement on the back of the lots "going away" because of
positive drainage across the lots. If I know those trees will not have to be disturbed, most all the trees can
remain in place, and you can work with the builders and contractors to avoid damaging them. Thanks!

This letter serves to acknowledge receipt of the Master Infrastructure Plans for review. After
reviewing the plans the Highway Department has the following comments:
1. An Application for Project Review must be completed and the appropriate review fees
paid prior to any approvals from this office. The application is available on the County
Website.
2. Correct the cross-section on Sheet C402. The 2% slope off of 146th Street must
continue to the curb. The asphalt section is as follows:
165 #/sys OC/OA-HMA-SMA, 3, 70-22, Surface, 9.5mm on
275 #/sys OC/QA-HMA, 3, 70-22, Intermediate, 19.0mm on
440 #/sys OC/QA-HMA, 3, 64-22, Base, 19.0mm on
300 #/sys OC/OA-HMA, 5,76-22, Intermediate, OG19.0mm on
440 #/sys OC/OA-HMA, 3, 64-22, Base, 19.0mm
3. Note that curb ramps on 1461h Street are only to be installed with the addition of a traffic
signal at the intersection of 146th Street and Community Drive. The associated curb
modifications for the ramps may be installed during entrance construction.
4. Curb ramps must be ADA compliant and must meet INDOT standard specifications. No
modifications of the standard will be allowed.
5. Show Raised Pavement Markings on the Traffic Control Sheet. Spacing is to be 40' on
solid white lines for both deceleration lanes.
6. Remove "ONLY" from the turn arrow in the deceleration lane.

7. White lines are to be Thermoplastic. The Right Turn Arrows and the "ONLY" In the
median deceleration lane are to be Preformed Tape.
8. Change the note on Sheet C406 concerning lane restrictions to read: Any planned lane
restriction for more than 15 minutes will not be allowed except as approved by the
Hamilton County Board of Commissioners at a regularly scheduled meeting. Any lane
restriction will require advanced warning signs and flaggers.
9. Place a note on Sheet C402 that states: Gutter Inlet Frame and Grate (R-3291) must be
adjusted to match the slope and elevation of the deceleration lane.
10. New inlets are required in the curb directly behind the existing inlets in 146th Street. The
associated manhole structures must be replaced.
11. Label the median sign to be installed as an R3-5. A Type I square post, 2.25" X 2.25"-
12 gauge with a 2.50" X 2.50 " anchor base, is required.
12. Please include a note that states: decorative signs, sprinkler systems, trees, landscaping
mounds, fences, light poles or other such amenities are not permitted within the Right-of-
Way.
13. The Public/Private Road Approach permit will not be approved until a written agreement
between the County and the Owner concerning signalization of 146th Street and
Community Drive has been executed.
14. Additional comments may be needed at a later date.

Angie,
We discussed the issue of cuts with the Board of Commissioners late in August. The
direction that they gave us was to allow one (1) cut for the entire project. That cut is
Community Drive. To say the least, Platinum is quite unhappy. They are trying to meet
with the Board to persuade them otherwise. To my knowledge that meeting has not happened.
I think that I sent my e-mail string, between me and Tim, over to Mike McBride and Gary
Duncan. I will try to send my e-mails to you also. Let me know if you still have
questions.
At this time I am working with Brett Huff on the revisions/additions to the plans
concerning Community Drive. We may have the details worked out on it by late next week.
In addition, we are working on an agreement concerning a signal at 146th & Community.
That agreement must be in place prior to us approving Community Drive.

Members of the Plan Commission:
These comments are regarding Docket No. 07070058 PP, Primary Plat Application by
Platinum Properties, LLC for a Section of the Legacy Development.
1. Our first concern is for traffic on Cherry Tree Road just West of this proposed
development. The plans for this development show a connecting road (Kiel Drive) to the
West joining this 126 lot Section to the proposed 32 lot Cherry Tree Grove development.
Because this proposed Legacy Section's only access to I46th St to the North is a STOP
SIGN controlled intersection with that 4 lane divided boulevard, it is obvious that many
of the vehicles from the Legacy development will cut through the Cherry Tree Grove
development to Cherry Tree Rd to access I 46thSt at the Traffic Signal controlled
intersection with Cherry Tree.
Cherry Tree Rd is a narrow, barely 2 lane country road which is already carrying f)
increased traffic from the 300 home Pulte Subdivision to the South. It should not be ~0.

shown in the Plat plan. These mature trees should be maintained!
This Primary Plat is the beginning of a huge development please get it started correctly
by considering the effects on the existing surrounding homes and roads.

Dear Mr. Littlejohn:
Enclosed please find a Primary Plat which has been revised in accordance
with the comments listed in your letter dated August 6, 2007. Those comments
were addressed as follows:
1. We have revised the Preliminary Plat to illustrate the type and size of
the primary walking path.
2. We have revised the primary walking path to illustrate a connection
from the end of Integrity Court to Common Area #7.
3. Per our topographical survey, there is a significant amount of grade
change and existing trees in this area. It is not going to be possible to
provide a pedestrianlbicycle access in this area.
4. We have revised the Preliminary Plat to illustrate that all proposed
sidewalks are to be a minimum of 5' in width.
5. We have added a proposed 5' sidewalk in front of Lots 100-103 per your
request.
6. We have added ADA compliant handicap ramps at all crosswalks.

Thanks for the clarification. A.s I am sure you were expecting, we will be contacting the
commissionsers directly to discuss as it will not be acceptable to have no other entrances
on 146th Street. Especially in areas where there is no other way to access the property
due to soil conditions.

Tim,
Continue with Community Drive as planned. I think that any stipulations will be in the
form of an agreement concerning the signalization of the intersection. The Board of
Commissioners would expect the owner of the development to bear the cost of a signal, its
design and all necessary items at the time it is warranted.
There,have not been any discussions with the developer to the north concerning
signalization, except that they know if Community Drive connects to the south, it is a
possibility.
I have not received the plans yet. As soon as I do, I will take a look reasonably quick.
I will be out of town part of next week for a seminar, so I'm trying to get ahead on plan
review.
Take a look at your interior streets, their connections and construction timing to
eliminate additional entrances. Frontage roads were a topic of discussion along with the
timing of Cherry Creek Boulevard and the connection of it to River Road, Community Drive
and west to Cherry Tree Road/Hazel Dell Road.

We had a chance to sit down with the Commissioners today. We discussed the project as
well as 146th in general. The Commissioners are willing to allow the access point at
Community Drive. That entrance will most likely have some stipulations, due to the fact
that it will warrant a signal in the future. Beyond the entrance at Community Drive, you
need to look at internal traffic circulation.
I am currently working to get you the new Mix Design for 146th Street.
I will have that to you on Monday.
