City of Carmel V Joseph Mutchler Release Release And Covenant Not To Sue
1, /It being eighteen (18) years of age or
olif and 4f sound mini, on behalf of myself and my heirs, executors, administrators,
successors, assigns, personal representatives, estate and/or anyone else who might make a
claim on my behalf, and in consideration of the City of Carmel's agreement to remove
certain trees "Trees from my real property located at
Carmel, Indiana, (the "Property do hereby agree and
covenant to forever waive, release and discharge the City of Carmel, Indiana and all other
City entities, elected or appointed officials, employees, officers, attorneys, workers,
volunteers and all other persons whatsoever, jointly and individually, and the
representatives, successors and assigns of same (collectively, the "City from any and all
liabilities, claims, demands, controversies, damages, costs, expenses, actions and causes
of action whatsoever, whether foreseen or unforeseen, known or unknown, developed or
undeveloped, patent or latent, for my and/or another's death, disability, personal injury
and/or all personal, real and/or other property damage directly or indirectly arising out of
the City's removal of said Trees. I hereby further agree and covenant to refrain from
initiating, pressing, collecting or in any way aiding or proceeding upon any and all actions
and causes of action against City for any and all damages, costs, expenses, lost
opportunities, compensation or any other compensatory, punitive, equitable or other relief
whatsoever and however arising, whether known or unknown, foreseen or unforeseen,
developed or undeveloped, patent or latent, which I had, now have or may have against
the City after the execution of this Release and Covenant Not To Sue arising out of, based
upon or associated with the removal of said Trees.
I further agree to indemnify and hold harmless City, its employees, officers, officials,
members, employees, invitees, licensees, agents and legal representatives, from and
against any and all losses, liabilities, claims, judgments, costs (including, but not limited
to, attorney fees and court costs) and damages (including, but not limited to, those
claimed as a result of any bodily injury or death to persons and/or the destruction of any
property) occurring on the Property and resulting directly or indirectly from City's or any
other person's acts thereon and/or the removal of the Trees.
