N/A Brochure, "Relocation You REMARKS: I contacted Gary Secrest as directed within the appraisal report and explained that I am assisting the City of Carmel with the road improvement project at 106 Street and Keystone Parkway. When given the option to meet in person for the presentation of the offer or having it mailed via "Certified Mail Mr. Secrest preferred the packet be mailed and they would call subsequent to its review with questions. He provided an alternate mailing address for mailing purposes. The offer packet was mailed via "Certified" mail, return receipt requested, on January 24, 2008, with a date of delivery on January 26, 2008. The Uniform Property or Easement Acquisition Offer letter, in accordance with I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject the City's offer. The 30 days may be waived and the offer accepted or rejected now or at anytime during this period. It was also indicated that the legally protected rights and= under Indiana's eminent domain law are set forth on page two of the Uniform Property or Easement Offer Letter, as well as within the booklet, "ACQUISITION, Acquiring Real Property for Federal and Federal -Aid Programs and Protects It was explained that typically, the City makes payment within 90 days after receiving the secured parcel file from the consultant and Indiana law dictates that possession of the property will transfer to the City thirty (30) days after payment is received. The introductory letter mailed in conjunction with the offer explained that the project is to improve N. Keystone Parkway and E. 106 Street. More specifically, a portion of the subject property is required as permanent right -of -way. The permanent acquisition, known as Parcel 23, contains 0.648 acres, of which 0.096 acres is existing right -of -way under pavement. As explained in the form, "Owner's Private Appraisal Letter the owner or its representative may submit an independent appraisal for review at its own expense. REMARKS: Gary Secrest telephoned and stated that the offer amount appears agreeable. There are two signs that are located within the acquisition area. Compensation was included for their relocation. Mr. Secrest explained that they plan to only move one of the two. 2/26/08 (2:00 pm) I spoke with Mr. Secrest. He provided a verbal acceptance of the offer and stated that the executed forms are forthcoming. The pertinent forms were later received fully executed. Two mortgages were indicated in the Title and Encumbrance Report requiring releases. A substantial amount of time elapsed during which the owner worked with the mortgagee regarding the releases. Copies of the releases were provided on August 11, 2008. The mortgagee is requiring $30,000 of the proceeds be applied to the mortgage balance. Once the money is received, the original documents will be provided. The Hamilton County Treasurer's office confirmed that property taxes on the subject property are paid current. The Receipt of Conveyance Instrument was later mailed to Mr. Secrest.
