REMARKS: I telephoned a number previously utilized as a contact for Mr. John C. Hart. A message was left
explaining that the appraisal phase was complete and a monetary offer was being forwarded by certified mail to
his attention. Consequently, the pertinent forms and related information were mailed "Certified Return Receipt
Requested" on January 30, 2008, with a date of delivery on February 1, 2008. Included within the packet were
the following forms /documents: an introductory letter, the booklet, "ACQUISITION, Acquiring Real Property for
Federal And Federal -Aid Programs and Protects and the letter acknowledging its receipt, the Confirmation of
Opportunity to Accompany Appraiser on Inspection, the Statement of the Basis for Just Compensation, the
Appraisal Report, the Uniform Land or Easement Acquisition Offer letter, the Warranty Deed with Exhibits "A" and
"B the Sales Disclosure Form, the Accounts Payable Voucher, the Request for Taxpayer Identification Number

eminent domain law are set forth on page two of the Uniform Land or Easement Offer Letter, as well as within the
booklet. It was explained that typically, the City makes payment within 90 days after receiving the secured parcel
file from the consultant and Indiana law dictates that possession of the property will transfer to the City thirty (30)
days after payment is received. The introductory letter mailed in conjunction with the offer explained that the
project is to improve N. Keystone Parkway and E. 106' Street. More specifically, the entire Lot 49 as well as the
common area is required as permanent (fee simple) right -of -way, which contains 11,777 square feet (0.270 acres).

REMARKS: Subsequent to receipt and review of the offer packet, Mr. Hart forwarded an email. He inquired if
the offer was inclusive of Lot #49 and the Common Area. He explained that the Common Area may have already
been dedicated. Additionally, he stated that he does not believe that the value offered is represented of the value
of Lot #49 plus the Common Area. He suggested that the appraiser may have been amiss regarding the zoning
of the property relative to value.
2/7/08 (3:00 pm) I forwarded an email response explaining that the offer does in fact include Lot #49 as well as
the Common Area along 126 Street. They have similar ownership and are contiguous and thus, considered one
parcel. I explained that I would inquire if a separate legal description could be prepared and this area conveyed
via a Quit Claim Deed. I also inquired if there was a specific monetary amount that would make the offer
acceptable.

REMARKS: I telephoned Mr. Hart and explained that the Right of Entry document was inadvertently left out of
the original offer packet. Mr. Hart believes the offer is low and may pursue obtaining an independent appraisal.
However, he explained that his appraiser, Mike Lady, is out of town until later in the week. Mr. Hart stated that
if the City would be willing to settle at the original list price of $49,900.00 then he would forego the appraisal and

REMARKS: The City of Carmel is willing to settle the parcel for a total compensation of $47,000.00. However,
I received an email message from Mr. Hart explaining that they would not be willing to take any action as it pertains
to the common property. He advised me to contact Lee Geupel at Kirkpatrick Management who represents the
association regarding the common property.
2/27/08 (2:00 pm) I contacted Mr. Geupel and he suggested that I contact Vickie Norma, who is the Board

REMARKS: I forwarded an email message to Mr. Hart and Ms. Norman explaining that the City's position is that
the administrative settlement discussed and totaling $47,000.00 compensates for both Lot #49 and the common
area. The City is willing to add a "Do Not Disturb" note to the plans and work around the stone sign and stone
wall. Additionally, they are willing to consider compensating for the relocation of the fence as well if an amicable
agreement can be reached. I inquired if they would be able to provide an estimate to have the fence relocated
and provide it for the City's consideration. I explained to Ms. Norman that Mr. Hart is requesting the HOA's
consent to sign the Right of Entry. She responded via email that she would consult the board for a decision.

REMARKS: I received an email message from Mr. Hart and the following day, one from Ms. Norman. Both are
of the opinion that the appraisal does not adequately separate the value and just compensation offered for Lot #49
versus the affected common area. Mr. Hart plans to discuss the situation with his appraiser and obtain an
independent appraisal. Neither party wishes to move forward until that is accomplished.
Due to the status of the parcel and the critical time constraints on the project, I was advised that the City of Carmel
plans to move forward with the eminent domain proceedings and will file the Complaint For the Appropriation of
the Real Estate.

REMARKS: I received an email message from Ms. Norman explaining that the common area has been legally
transferred into the name of The Enclave of Carmel Homeowners Associate, Inc., with a copy of the recorded deed
attached.
Due to the court filing, the City attorney worked directly with the Homeowners Association and negotiated a
settlement for $9,247.60 and other terms involving the affected land improvements. The pertinent
forms /documents securing the parcel were forwarded to me from Alan Townsend, the attorney working on behalf
of the City. Mr. Townsend is handling the negotiation for Lot #49.

The Court appointed appraisers have filed their reports in which they determined that the
Defendant, The Enclave Development Company, Inc., may be entitled to total just compensation

1. The Plaintiff, the City of Carmel, shall pay to the Clerk of this Court the total
