REMARKS: Mrs. Augenbergs telephoned in response to a message left the previous day. I explained that I am
assisting the City of Carmel with the acquisition phase of the Keystone Parkway improvement project and need
to present a monetary offer for additional right -of -way needed. I provided Mrs. Augenbergs the option to meet in
person for the presentation of the offer or it could be mailed. She stated that they preferred to meet, however,
they are unable to meet until July 20 I suggested that we schedule an appointment for the 20 now but in the
mean time, I will forward the offer and related information via "Certified" mail. Mrs. Augenbergs agreed and
confirmed ownership as well as the mailing address. Consequently, the offer and related information were mailed
via "Certified mail, Return Receipt Requested on July 10, 2009, with a date of delivery on July 14, 2009. Included
within the packet were the following forms /documents: an introductory letter, the Statement of the Basis for Just
Compensation, the Waiver Valuation, the Uniform Property or Easement Acquisition Offer letter, the Warranty
Deed with Exhibits "A" and "B the Temporary Easement Agreement with Exhibits "A" and "B (2) Sales

REMARKS (Cont'd): Certification (Form W -9), the form, "Owner's Private Appraisal Letter the Right of Entry,
and a highlighted copy of the plan sheet. The introductory letter mailed in conjunction with the offer explained that
the project is to improve N. Keystone Parkway and 131S Street. More specifically, a portion of the subject property
is required as a permanent right -of -way. The permanent right -of -way, known as Parcels 73 and 73A, contain a
total of 244 square feet. The temporary easement, known as Parcel 73B, contains 725 square feet. It is needed
for drive construction and will revert to you upon completion of the project. The Uniform Property or Easement
Acquisition Offer letter, in accordance with I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject
the City's offer. The 30 days may be waived and the offer accepted or rejected now or at anytime during this
period. It was also indicated that the legally protected rights and options under Indiana's eminent domain law are
set forth on page two of the Uniform Property or Easement Offer Letter. It was explained that typically, the City
makes payment within 90 days after receiving the secured parcel file from the consultant and Indiana law dictates
that possession of the property will transfer to the City thirty (30) days after payment is received. As explained in
the form, "Owner's Private Appraisal Letter the Mr. and Mrs. Augenbergs may submit an independent appraisal
for review at their own expense. The forms /documents requiring signatures and notarization were indicated. Mr.
and Mrs. Auqenberqs were encouraged to call with any questions or to schedule an appointment.

REMARKS: I telephoned Mr. Augenbergs to inquire of the possibility of rescheduling our appointment to
Tuesday July 21S as another property owner wanted to meet but was unavailable on Monday the 20 Mr.
Augenbergs agreed and the appointment was scheduled for Tuesday, July 21s at 6:00 pm.
7/16/09 (2:50 pm) I returned a call to Mr. Augenbergs. They had received the offer packet and had questions
with regard to the trees to be affected and the construction of a turn around. I explained that the trees along the
proposed right -of -way line would need to be removed. However, the pine tree located next to the drive does not
appear to be within the construction limits and may not be affected. I explained that when we meet on the 21s I
will measure to get a better indication of which land improvements will be affected. As for the construction of a turn
around, I have no knowledge nor see any indication of one to be constructed for the property. Mr. Augenbergs
explained that the possibility of constructing a turn around was discussed with Mike McBride, Jeremy Kashman
and Mayor Baynard. I explained that I would see if I could obtain some additional information for them.

REMARKS: At the prearranged time, I met with Mr. and Mrs. Augenbergs at the subject property. We reviewed
the plans and walked the proposed acquisition. We visually determined the trees to be affected and the location
of the proposed drive and multi -use path. We discussed the possibility of constructing a turn around to enable
them to maneuver into and out of their drive more easily. I explained that this is a possibility but the City prefers
not to alter the plans until an agreement is made with regards to the offer. Mrs. Augenbergs inquired of the
possibility of the property being purchased in total, which reportedly was already discussed with the Mayor. She
further explained that she believes, as do various real estate agents, that the value of the home is greatly
diminished due to the acquisition and construction of the road. I explained that I would forward their request to
the City and once I received a response, I would let them know. I further explained that it would be a lengthy
process as various factors such as additional appraisals would be involved with the decision making.

REMARKS: Mr. Augenbergs telephoned in response to a message I had left with regards to the possibility of
the subject property being purchased in total. I inquired if he and Mrs. Augenbergs had discussed an acceptable
dollar amount. He stated due to information provided by agents and given the market conditions, they would
consider $245,000.00. I explained that I would forward the amount to the City and would be in contact once I
received additional information.
9/1/09 (9:20 am) Mrs. Augenbergs telephoned concerned about work being done in their front yard. I inquired
as to the location of the work as there is existing right -of -way. She believed that the machinery and the pile of dirt
was outside the existing right -of -way. I explained that I would try to obtain additional information and contact her
once I received a response. The next morning, I left a message for Mrs. Augenbergs. I explained that Vectren was
in the area working on the gas lines. They were connecting the line to their home gas line as to be sure they did
not experience any disrupted service. I further explained that they were doing their best to stay within the existing

REMARKS (Cont'd): right -of -way and the work would hopefully be done by the end of the week. I explained that
I had received a response from the City stating that $245,000.00 is more than what was paid to other property
owners with similar houses. I inquired if they had any additional information to support that value or if a lower
figure would be acceptable.
9/2/09 (10:00 am) Mrs. Augenbergs promptly returned my call. She explained that during discussions with the
Mayor, they had told him over $200,000 and he was agreeable. Mayor Brainard also agreed to include moving
expenses which was also a portion of the number provided. However, she further explained that they had been
in contact with 2 different realtors who pulled comparable sales to support the value. Reportedly, the home was
last appraised over $200,000.00, however, that was some time ago.
9/3/09 (10:15 am) Mr. Augenbergs telephoned and explained that they were flexible with regards to the price of
the home and inquired if the City had an amount in mind. I explained that the City did not have a value as an
appraisal on the property had not been done. I further explained that I would forward the additional information
to the City and be in contact once I received additional information.

REMARKS: Mrs. Augenbergs telephoned to inquire if I had received any additional information with regards to
the City acquiring the subject property in total. I explained that I have been inquiring of the status myself but have
not received an answer. I explained that once I received additional information, I would contact them.
2/22/10 (2:45 pm) Mrs. Augenbergs telephoned. She explained that during the demolition of the neighboring
property, a portion of their fence had been knocked down and landed on their car. She explained that they had
already contacted the City with regard to the damaqe and was told that it would be fixed. However, nothing has
been done about it. I explained that I would check to see what is going on and get back with her once I received
some answers. She explained that they are going to seek the advise of an appraiser as well as an attorney to get
this resolved. I explained that I would pass this information along to the City as well as see if I can get any
answers with regard to the fence. I forwarded on to the City that the Auqenbergs had experienced some damage
during the demolition of the neighboring property. I received a response from Jeremy Kashman stating that he
had been notified of the situation and would see that it was taken care of by the contractor.

REMARKS: I left a message for Mrs.Augenbergs explaining that I had not received any response from the City
with regard to the possibility of the subject property being acquired in total. I also inquired if the fencing had been
repaired. I requested that they return my call should they need further assistance and explained that I would call
them once I received a response from the City.
Without further correspondence, the fully executed documents were received from Jeremy Kashman with the City
of Carmel. The Hamilton County Treasurer was contacted and indicated that there were delinquent taxes owed
on the property. I left a message for Mr. and Mrs. Augenbergs explaining the situation as well as emailing them
a copy of the tax print out. Upon notification of payment, the Receipt of Conveyance Instrument was forwarded
to Mr. and Mrs. Augenbergs.
