REMARKS: I telephoned the number provided within the appraisal report and left a message for Mr. Haagsma.
He returned my call the following day (7/10/09 9:00 am). I explained that I am assisting the City of Carmel with
the acquisition phase of the Keystone Parkway and 131' Street improvement project. In conjunction with the
project, an offer needs to be extended for the purchase of the required right -of -way. Mr. Haagsma was aware that
the proposed right -of -way will entail purchase of his entire property, including the dwelling. I provided the option
to meet for the presentation of the offer or it could be mailed "certified Mr. Haagsma preferred mailing and
confirmed his mailing address as well as ownership. Consequently, the offer and related information were mailed
via "Certified mail, Return Receipt Requested on July 10, 2009, with a date of delivery on July 11, 2009. Included
within the packet were the following forms /documents: an introductory letter, the Statement of the Basis for Just
Compensation, (2) Appraisal Reports, the Uniform Property or Easement Acquisition Offer letter, the Warranty
Deed with Limitation of Access with Exhibits "A" and "B the Sales Disclosure Form, the Accounts Payable
Voucher, the Request for Taxpayer Identification Number and Certification (Form W -9), the Retention of

REMARKS (Cont'd): Ownership (Fixtures and Parts) Form, the Disclosure of Lead -Based Paint Form, the
"Owner's Private Appraisal Letter and the Right of Entry document. The Uniform Property or Easement
Acquisition Offer letter, in accordance with I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject
the City's offer. The 30 days may be waived and the offer accepted or rejected now or at anytime during this
period. It was also indicated that the legally protected rights and options under Indiana's eminent domain law are
set forth on page two of the Uniform Property or Easement Offer Letter. It was explained that typically, the City
makes payment within 90 days after receiving the secured parcel file from the consultant and Indiana law dictates
that possession of the property will transfer to the City thirty (30) days after payment is received. The introductory
letter provided in conjunction with the offer explained that the project is to improve N. Keystone Parkway and 131s
Street. More specifically, the entire subject property is being acquired as permanent (fee simple) right -of -way. The
permanent right -of -way, known as Parcel 75, contains 15,918 square feet. This includes 7,228 square feet of
excess land. The forms /documents requiring signatures and notarization were indicated. Mr. Haagsma was
encouraged to call with questions or to schedule an appointment to meet.

REMARKS: Mr. Haaqsma telephoned subsequent to receipt of the offer packet and its review. We discussed
the timing of the project and the statutory time to consider the offer. The Retention of Ownership form was also
discussed. He was unsure at this point if anything would be retained. I explained the City has decided to have
a typical closing and Chicago Title will handle it. The property taxes will be prorated and the closing costs will be
the City's responsibility. Mr. Haagsma stated that the offer seemed reasonable but he needed some additional
time to think it over.

the Mayor explained to another property owner that they could have an additional 10% without seeking attorney

REMARKS: I contacted Mr. Haagsma and explained that without supporting documentation, the City was
unwilling to increase the offer by $15,000.00. However, the City was willing to administratively settle for an
additional $7,000.00 or $182,000.00. Mr. Haagsma verbally accepted.
9/1/09 (2:30 pm) As arranged, I met with Mr. Haagsma. All pertinent forms were signed and I provided notary
assistance. These forms were forwarded to the City and Chicago Title to prepare for a closing.
9/17/09 (1:30 pm) Mr. Haaqsma and I met at Chicago Title offices. The closing was completed and all forms
were signed. Chicago Title will be responsible for forwarding the payoff check to the existing mortgagee to satisfy
it as well as forwarding the check to the Treasurer's office to pay the Fall 2008 taxes due in 2009. The property
taxes were prorated to the day of closing and thus the City was credited for 1/1/09 9/17/09 property taxes.
