REMARKS: I telephoned the number provided within the Appraisal Report and spoke with Mr. Marcus P.
Guttrich. I explained that I am assisting the City of Carmel with the acquisition phase of the Keystone Parkway
improvement project. In conjunction with the project, an offer for additional right -of -way needs to be presented.
I provided Mr. Guttrich the option to meet in person for the presentation of the offer or it could be mailed "certified

information were mailed via "Certified mail, Return Receipt Requested on July 9, 2009, with a date of delivery
on July 10, 2009. Included within the packet were the following forms /documents: an introductory letter, the

Acquisition Offer letter, the Warranty Deed with Limitation of Access with Exhibits "A" and "B the Temporary

REMARKS (Cont'd): plan sheet. The Uniform Property or Easement Acquisition Offer letter, in accordance with
I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject the City's offer. The 30 days may be waived
and the offer accepted or rejected now or at anytime during this period. It was also indicated that the legally
protected rights and options under Indiana's eminent domain law are set forth on page two of the Uniform Land
or Easement Offer Letter. It was explained that typically, the City makes payment within 90 days after receiving
the secured parcel file from the consultant and Indiana law dictates that possession of the property will transfer
to the City thirty (30) days after payment is received. The introductory letter mailed in conjunction with the offer
explained that the project is to improve N. Keystone Parkway and 131' Street. More specifically, a portion of the
subject property is required as a permanent right -of -way with limitation of access and a temporary easement. The
permanent right -of -way with limitation of access, known as Parcel 76, contains 1,169 square feet. The temporary
easement, known as Parcel 76A, contains 300 square feet. It is needed for drive construction and will revert to
you upon completion of the project. As explained in the form, "Owner's Private Appraisal Letter Mr. Guttrich may
submit an independent appraisal for review at his own expense. The forms /documents requiring signatures and
notarization were indicated. Mr. Guttrich were encouraged to call with any questions or to schedule an
appointment.
7/23/09 (10:15 am) Mr. Guttrich telephoned in response to a previous message. He requested that we meet
to review the offer and corresponding documents. An appointment was set for the following day, Friday July 24
at 10:00 am.

REMARKS: At the prearranged time I met with Mr. Guttrich and his son at the subject property. We briefly reviewed
the plans as well as cross sections. I explained that the intersection of Keystone Parkway and 131s Street will be
constructed similar to the roundabout located at 106 and Keystone Parkway. I indicated to Mr. Guttrich on the plans
the proposed acquisition areas and explained that the raised center median along 131s Street will extend past his
drive, allowing entrance only from the east. The three trees compensated for in the appraisal report were shown.
I explained that two of the three were not within the construction limits and may not be disturbed. Mr. Guttrich
requested all three (3) trees be removed. As the property had been staked, we were visually able to correspond the
points on the plans with the actual area. Mr. Guttrich was agreeable to the plans as proposed. We then proceeded
to review the offer and corresponding documents. Mr. Guttrich accepted the offer as presented and signed the
required documents. I provided notary assistance. Mr. Guttrich confirmed the mortgage information provided within
the Title and Encumbrance Report.
Upon receipt of the partial release from National City, the Hamilton County Treasurer was contacted and confirmed
that property taxes were pad current. The Receipt of Conveyance Instrument was forwarded to Mr. Guttrich.
