REMARKS: Mr. Christopher L. Covey telephoned in response to my message. I explained that I am assisting
the City of Carmel with the acquisition phase of the Keystone Parkway improvement project. In conjunction with
the project, an offer for a temporary easement needs to be presented. Mr. Covey is familiar with the project as he
met with the appraiser during the inspection. We briefly discussed the project. Mr. Covey inquired as to when
the fence would need to be relocated. I explained that construction is scheduled to start Spring of 2010. However,
the City is planning to begin clearing later this fall. I provided Mr. Covey the option to meet for the presentation
of the offer or it could be mailed "certified." He preferred mailing and confirmed ownership as well as the mailing
address. Subsequently, the offer and related information were mailed via "Certified mail, Return Receipt
Requested on July 10, 2009, with a date of delivery on July 13, 2009. Included within the packet were the
following forms /documents: an introductory letter, the Statement of the Basis for Just Compensation, the Waiver
Valuation, the Uniform Property or Easement Acquisition Offer letter, the Temporary Easement Agreement with
Exhibit "A" and "B the Sales Disclosure Form, the Accounts Payable Voucher, the Request for Taxpayer

REMARKS (Cont'd): Identification Number and Certification (Form W -9), the "Owner's Private Appraisal Letter
the Right of Entry, and a highlighted plan sheet. The Uniform Property or Easement Acquisition Offer letter, in
accordance with I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject the City's offer. The 30
days may be waived and the offer accepted or rejected now or at anytime during this period. It was also indicated
that the legally protected rights and options under Indiana's eminent domain law are set forth on page two of the
Uniform Land or Easement Offer Letter. It was explained that typically, the City makes payment within 90 days
after receiving the secured parcel file from the consultant and Indiana law dictates that possession of the property
will transfer to the City thirty (30) days after payment is received. The introductory letter mailed in conjunction with
the offer explained that the project is to improve N. Keystone Parkway and 131s Street. More specifically, a
portion of the subject property is required as a temporary easement. The temporary easement, known as Parcel
81, contains 492 square feet and is needed for grading. It will revert to you upon completion of the project. As
explained in the form, "Owner's Private Appraisal Letter Mr. and Mrs. Covey may submit an independent
appraisal for review at their own expense. The forms /documents requiring signatures and notarization were
indicated. Mr. and Mrs. Covey were encouraged to call with any questions or to schedule an appointment.
7/21/09 (12:30 pm) Mr. Covey telephoned in response to the offer presented. He explained that he had an
estimate from Award Fence Deck to relocate the fence for $2,087.00, which is roughly $300.00 more than the
estimate included in the Waiver Valuation. Mr. Covey also indicated that he did not agree with the compensation
provided for the loss of 2 trees. We briefly discussed that compensation for trees is based on contributory value.
He explained that the trees in the back provide privacy and block the traffic noise. Mr. Covey had also obtained
an estimate for the replacement of the 2 trees. I inquired if Mr. Covey would forward the estimates to my attention
so that I could submit them to the City of Carmel for review and consideration. Mr. Covey promptly forwarded the
estimates via e-mail and U.S. Post. They were then forwarded to the City of Carmel for review.
8/11/09 (2:00 pm) I received an email for Jeremy Kashman of the City of Carmel approving an administrative
settlement in the amount of $1,287.00 for a total compensation of $3,962.00. I telephoned Mr.Covey and
explained that the City was willing to provide additional compensation for the trees and fence relocation. He
verbally accepted the offer and an appointment was schedule for Tuesday, August 11 at 9:00 am to execute the
required documents.

REMARKS: At the prearranged time, I met with Mr. and Mrs. Covey at the subject property. We briefly reviewed
the plans as well as cross sections, specifically as to how they pertain to Mr. and Mrs. Covey's residence. I
explained that the intersection of 131S Street and Keystone Parkway is to look similar to the roundabout
constructed at Keystone Parkway and 106 Street. Mr. Covey inquired about drainage. He stated that currently
all of the run off from the intersection and homes along Carmel drive flow towards his home and into his basement
window. I indicated on the plans where curbing and gutters are to be installed as well as drainage pipes are
proposed. Mr. and Mrs. Covey were agreeable with the proposed construction plans as well as the administrative
offer. The revised documents were presented and signed. I provided notary assistance. Mr. Covey and I then
proceeded to walk the proposed area. He inquired when the fence needed to be relocated. I explained that I did
not have a specific date, but would inquire for him. The Receipt of Conveyance Instrument was later forwarded
to Mr. and Mrs. Covey.
