I explained I am assisting the City of Carmel with the acquisition phase of the Keystone Parkway improvement project. In conjunction with the project, an offer for a temporary easement needs to be presented. I provided the option to meet for the presentation of the offer or it could be mailed "certified Mr. Landis preferred mailing and confirmed the mailing address as well as ownership. We briefly discussed the project. I explained that the proposed acquisition area is temporary in nature and will revert to them once the project is complete. Mr. Landis explained that if at all possible, they would prefer not to be disturbed. The area in question is part of his wife's garden. This area includes a raised bed with various types of plants as well as planting soil. I explained I would inquire if eliminating the parcel was a possibility. In the mean time, I would forward the offer and related information for their review. Mr. Landis inquired of the time line of the project, including when the neighbors' home would be demolished. I explained that currently the City plans to clear the right of way and utility work later this fall with major construction to start next spring. Included within the packet were the following forms /documents: an introductory letter, the Statement of the Basis for Just Compensation, the Waiver Valuation, the Uniform Property or Easement Acquisition Offer letter, the Temporary Easement Agreement with Exhibit "A" and "B the Sales Disclosure Form, the Accounts Payable Voucher, the "Request for Taxpayer Identification Number and Certification (Form W -9), the "Owner's Private Appraisal Letter the Right of Entry, and a highlighted plan sheet. The Uniform Property or Easement Acquisition Offer letter, in accordance with I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject the City's offer. The 30 days may be waived and the offer accepted or rejected now or at anytime during this period. it was also indicated that the legally protected rights and options under Indiana's eminent domain law are set forth on page two of the Uniform Land or Easement Offer Letter. It was explained that typically, the City makes payment within 90 days after receiving the secured parcel file from the consultant and Indiana law dictates that possession of the property will transfer to the City thirty (30) days after payment is received. The introductory letter mailed in conjunction with the offer explained that the project is to improve N. Keystone Parkway and 131" Street. More specifically, a portion of the subject property is required as a temporary easement. The temporary easement, known as Parcel 105, contains 226 square feet. As explained in the form, "Owner's Private Appraisal Letter Mr. and Mrs. Landis may submit an independent appraisal for review at their own expense. The forms /documents requiring signatures and notarization were indicated. Mr. and Mrs. Landis were encouraged to call with any questions or to schedule an appointment. 7/14/09 (9:00 am) Upon review of the offer and related information, Mr. Landis telephoned to further discuss the project. He requested that the proposed acquisition area be staked so that he could get a better understanding of what the project entails specifically to his property. We discussed the compensation included for relocating the fence. I explained that $1,290.00 was included in the offer to relocate the fence two times, once temporarily and then back to the permanent location. This would be his responsibility to relocate the fence and need completed prior to construction. Should he believe that this amount is not adequate, he could obtain an estimate and submit it to the City for review and consideration. He stated that there is currently a steel fence along what is the current limited access right of way line and inquired if it is to be removed. I explained that it would have to be removed in the subject area for construction, but I am not positive if it will be replaced. He stated that he prefers it be removed the entire length of the property so the area could be maintained. I offered to meet with Mr. and Mrs. Landis should they be interested. I explained that I had contacted the City of Carmel regarding the elimination of the parcel and they do not feel comfortable eliminating it. However, I stated that they would advise the contractors to do their best to avoid the area. Additionally, some utility work may also be required in the proposed acquisition area. Mr. Landis and I walked along proposed acquisition area. There is approximately 1 to 2 feet between the wooden privacy fence and the current steel fence along the limited access right -of -way line. Mr. Landis voiced his preference that the fence be removed, if possible, the entire length of his property. This would allow him to clean out and maintain the area, leaving a cleaner more beautiful appearance along the road. I explained that typically limited access right -of -way is fenced but I would voice his preference to the City. We briefly discussed the vacant house, owned by the City, next door. He inquired of what would be removed as part of the project and if the City would be willing to sell /deed the remainder of the property to him. I advised him to discuss this option directly with the City of Carmel. Mr. and Mrs. Landis accepted the offer presented and I provided notary assistance.
