REMARKS: I telephoned the number provided within the appraisal report and spoke with Mr. Michael Green. I
explained that I am assisting the City of Carmel with the acquisition phase of the Keystone Parkway and 136
Street improvement project. In conjunction with the project I need to present a monetary offer for the additional
right -of -way required for the project. I provided the option to have the offer presented in person or via "certified"
mail. Mr. Green opted for mailing. The acquisition area was discussed. Ownership was confirmed and an alternate
mailing address was provided. Consequently, the pertinent forms and related information were mailed via
"Certified mail, Return Receipt Requested on July 14, 2008, with a date of delivery on July 18, 2008. Included
within the packet were the following forms /documents: an introductory letter, the booklet, "ACQUISITION,
Acquiring Real Property for Federal And Federal -Aid Programs and Projects and the letter acknowledging its
receipt, the Confirmation of Opportunity to Accompany Appraiser on Inspection, the Statement of the Basis for
Just Compensation, the Appraisal Report, the Uniform Property or Easement Acquisition Offer letter, the Warranty
Deed with Exhibits A" and "B the Sales Disclosure Form, the Accounts Payable Voucher, the "Request for

REMARKS (Cont'd): Taxpayer Identification Number and Certification (Form W -9), the "Owner's Private Appraisal
Letter a copy of the highlighted plan sheet and the Right -of -Entry. The Uniform Property or Easement Acquisition
Offer letter, in accordance with I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject the City's
offer. The 30 days may be waived and the offer accepted or rejected now or at anytime during this period. It was
also indicated that the legally protected rights and options under Indiana's eminent domain law are set forth on
page two of the Uniform Land or Easement Offer Letter, as well as within the booklet, "ACQUISITION, Acquiring
Real Property for Federal and Federal -Aid Programs and Projects It was explained that typically, the City makes
payment within 90 days after receiving the secured parcel file from the consultant and Indiana law dictates that
possession of the property will transfer to the City thirty (30) days after payment is received. The introductory letter
mailed in conjunction with the offer explained that the project is to improve N. Keystone Parkway and 136 Street.
More specifically, a portion of the subject property is required as permanent right -of -way. The permanent
acquisition, known as Parcel 88, contains 0.193 acres. As explained in the form, "Owner's Private Appraisal
Letter Mr. Green may submit an independent appraisal for review at his own expense. The forms /documents
requiring signatures and notarization were indicated. Mr. Green was encouraged to call with any questions.

REMARKS: Subsequent to the review of the offer packet, Mr. Green telephoned. He requested a total of
$36,500.00, which is an additional $7,835.00. He believes that the project is the reason that he is having difficultly
in renting Tract 1 (2515 E. 136 Street). He also believes that the acquisition will have an effect on his ability to
park his equipment. Mr. Green's request was forwarded for consideration. The City agreed to an administrative
settlement in the amount of $30,000.00, which is an increase of $1,335.00. I telephoned Mr. Green and explained
to him what the City had countered at. He verbally accepted. I explained that some of the forms /documents would
require revisions. I later contacted Mr. Green and an appointment was scheduled for Monday, August 4 for the
purpose of executing the required forms.
8/4/08 (9:45 am) I met Mr. Green at his workplace. The revised documents were provided and each were signed.
I provided notary assistance. While preparing the file to forward for processing it was noted that the Title and

REMARKS (Cont'd): Encumbrance Report indicated a mortgage. I contacted Mr. Green and he explained that
the mortgage had been satisfied. I contacted the mortgage company and obtained a Satisfaction of Mortgage. The
Hamilton County Treasurer indicated that the taxes due for 2007 and payable for 2008 are now delinquent. I
contacted Mr. Green and he stated that he is disputing the current bill based on the large increase. The City
approved forwarding the secured parcel for payment without the taxes being paid current. The Receipt of
Conveyance Instrument was later forwarded to Mr. Green.
