It was also indicated that the legally protected rights and options under Indiana's eminent domain law are set forth on page two of the Uniform Land or Easement Offer Letter, as well as within the booklet, "ACQUISITION, Acquiring Real Property for Federal and Federal -Aid Programs and Proiects It was explained that typically, the City makes payment within 90 days after receiving the secured parcel file from the consultant and Indiana law dictates that possession of the property will transfer to the City thirty (30) days after payment is received. The introductory letter mailed in conjunction with the offer explained that the project is to improve N. Keystone Parkway and 136 Street. More specifically, a portion of the subject property is required as permanent right -of -way. The permanent acquisition, known as Parcel 102, contains 680 square feet. He stated that he would like to meet and would call the following day to schedule an appointment. However, I later received a letter from Mr. Joseph Hammes stating that he would be representing the owners and to address future communication to him. He requested a set of construction plans, which were forwarded on July 31S 8/6/08 (10:30 am) I telephoned Mr. Hammes to inquire of the status of the parcel. He stated that Mr. Dwyer had not yet picked up the plans. I later received a call from Mr. Dwyer. He stated that he was going by the attorney's office to pick up the plans and would drop by my office for their review. Mr. Dwyer met me later at my office. N/A Brochure, "Relocation You REMARKS: At the prearranged time, I met with Mr. and Mrs. Dwyer at the subject property. The plans were once again reviewed. The acquisition area was walked and proposed right -of -way was indicated. It was determined that the spruce trees along the southwest line of his property are not to be affected. However, there are natural occurring trees within the acquisition are that are to be removed. I explained that the appraiser had determined that the natural occurring trees and growth in the area were considered as contributing to the land value and a separate value was not given. Mr. Dwyer stated that the trees should have additional value. Mr. Dwyer stated that he would obtain an estimate for replacement trees as he believes that their privacy should be maintained. I inquired if Mr. Dwyer would be willing to execute a Right -of -Entry Document, which would allow the City to begin construction without delay. Mr. Dwyer declined. He believes the cost will be approximately $1,500.00 $2,000.00 per tree for a total of $8,000.00. The estimate should be complete this week. I once again inquired of the possibility of him executing a Right -of -Entry document. He stated that he would discuss it with his attorney. 9/2/08 (4:45 pm) Several conversations ensued. Mr. Dwyer indicated that Mr. Chad Walker would be assisting them with the conveyance document to convey ownership back into the trust as it had been inadvertently conveyed to Mr. and Mrs. Dwyer as husband and wife. He also stated that a counter is to be forwarded from Mr. Hammes. Prior to their receipt, it was decided that the parcel would be eliminated. A letter rescinding the uniform offer was mailed "certified" on October 27, 2008, with a date of delivery of November 6, 2008. Subsequent to its receipt Mr. Dwyer telephoned. I explained that it had been determined that the project would be constructed within existing right -of -way.
