REMARKS: Pastor Joseph Flatt telephoned in response to a message I had left. As we had previously spoken
in December he was familiar with the project. I explained that the appraisal phase had been completed and I would
like to present a monetary offer for the purchase of the required right -of -way. I provided the option to meet for the
presentation of the offer or it could be mailed "certified ". Pastor Flatt preferred that I mail the packet to the subject
property to his attention. Consequently, the pertinent forms and related information were mailed via "Certified mail,
Return Receipt Requested ", on January 25, 2008, with a_ date of delivery on January 28, 2008. Included within
the packet were the following forms /documents: an introductory letter, the booklet, "ACQUISITION, Acquiring Real
Property for Federal And Federal -Aid Programs and Projects ", and the letter acknowledging its receipt, the
Confirmation of Opportunity to Accompany Appraiser on Inspection, the Statement of the Basis for Just
Compensation, (2) Appraisal Reports, the Uniform Land or Easement Acquisition Offer letter, the Warranty Deed
with Exhibits "A" and "B ", the Sales Disclosure Form, the Accounts Payable Voucher, the Request for Taxpayer
Identification Number and Certification (Form W -9), the "Owner's Private Appraisal Letter ", and the highlighted
plan sheet. The introductory letter mailed in conjunction with the offer explained that the project is to improve N.

REMARKS (Cont'd): Keystone Parkway and E. 126th Street. More specifically, a portion of the subject property
is required as permanent right -of -way. The permanent acquisition, known as Parcel 62, contains 1.254 acres, of
which 0.246 acres is existing right -of -way under pavement. The Uniform Land or Easement Acquisition Offer letter,
in accordance with I.C. 32 -24 -1, provides only 30 days from its receipt to accept or reject the City's offer. The 30
days may be waived and the offer accepted or rejected now or at anytime during this period. It was also indicated
that the legally protected rights and options under Indiana's eminent domain law are set forth on page two of the
Uniform Land or Easement Offer Letter. It was explained that typically the City makes payment within 90 days after
receiving the secured parcel file from the consultant and Indiana law dictates that possession of the property will
transfer to the City thirty (30) days after payment is received. As explained in the form, "Owner's Private Appraisal
Letter ", the owners may submit an independent appraisal for review at their own expense. The forms /documents
requiring signatures and notarization were indicated. The owner or a representative was encouraged to call with
any questions.

REMARKS: I telephoned Pastor Flatt to inquire of the status of the parcel. He stated that he would be meeting
with the City's Engineer on February 20th to discuss the proposed construction,
2/27/08 (10:30 am) I telephoned and spoke with Pastor Flatt. He stated that they are considering granting a Right -of-
Entry.
2/28/08 (10:00 am) Mr. Randy Gerber, a member of the church, telephoned. He stated that there was a meeting
scheduled to discuss the project and its effect on to the subject property with Jeremy M. Kashman, P.E., Keystone
Project Manager. Subsequent to the meeting he would forward the executed Right -of -Entry. The Right -of -Entry was
executed on April 6, 2008.

REMARKS: I telephoned Mr. Gerber to inquire of the status of the parcel. He stated that they are waiting on
the road to be constructed to be able to determine how to negotiate for the relocation of the sign.
12/2/09 (11:15 am) Several conversations ensued with regard to the proposed acquisition. Subsequently, I spoke
with Mr. Gerber and he provided a counter, which includes the following:
They are requesting the higher of the two appraisals, which is $116,963.00 (an additional $19,368.00),
compensation for legal and engineering services ($3, 500.00), compensation for the relocation of light post and
signage ($15, 000.00) and compensation for loss of income. This amount totals $79, 868.00, however, they are only
requesting an additional $66,701.00
The City stated that they are willing to offer a revised value of $122,279.00 This includes our original offer in the
amount of $107,279.00 plus an additional $15,000.00 for the cost to cure items. I contacted Mr. Gerber and
provided th City's counter. Mr. Gerber said he would let me know.

REMARKS: Mr. Kashman contacted me and explained that he and Pastor Flatt were meeting to discuss the
Settlement. It was realized that the difference between the church and the City's counter offers was $13,468.00.
It was agreed to split the difference for an additional compensation in the amount of $6,734.00. Documentation
was later provided for the cost that they have incurred for services rendered on their behalf due to the right -of -way
acquisition. The revised documents reflecting the administrative settlement were forwarded to Mr. Gerber for
execution. The Title and Encumbrance Report indicated a mortgage with Union State Bank. I contacted Mr. Gerber
and explained that a release would need to be obtained. He explained that the mortgage had been satisfied and
a Cancellation of Mortgage was later received. As the executed documents were not received, I contacted Mr.
Gerber to inquire of their status. He stated that the hearing for their proposed sign is scheduled for April 26th. Mr.
Gerber stated that they would forward the executed documents should it be approved.

REMARKS: I telephoned Mr. Gerber to inquire of the status of the parcel. He explained that the Consent to
Encroach document's is awaiting approval. I later spoke with Jeremy Kashman and he further explained that the
document is in the process of getting reviewed by each of the City Departments. Subsequent to discussions
between the City of Carmel and the First Baptist Church of Carmel, the Consent to Encroach was approved. The
documents, which required execution were forwarded to Mr. Gerber for execution. The fully executed documents
were provided to Mr. Kashman. Mr. Kashman forwarded the documents and the secured file was forwarded for
processing. The Receipt of Conveyance Instrument was mailed to the owner.
